Information on the NLV from Brexpats -

“Those of you who do not qualify for residency here in Spain under the Withdrawal Agreement are considering the Non Lucrative Visa but what is it exactly and how do you apply for it?

“The Non Lucrative Visa (NLV) is a residency permit that will enable you to stay for ONE year in the first instance but this can be renewed. It is for those who will not be working here during that first year so possibly retiring here and I have heard it also referred to as the ‘Retirement Visa’.  It would also be applicable to those who can work here remotely with the UK or those who want to study or be on an internship here.

“All applications must be made to the Spanish Consulate in your country of origin.

FINANCIAL STATUS - You need to submit evidence of your financial status to prove that you will not become a financial burden on Spain, usually by means of the previous 6 months bank statements in your name. Currently for the first year this will be €25,816 pa in the bank for a single application and with an extra €6,454 for the spouse and for each child under the legal age (unless they are proven as your dependants). This doesn’t have to be all in the same bank and can be split in UK and Spanish bank accounts but must equate to a minimum of these amounts. Proof of relationship to spouse (marriage certificate or common law document) and birth certificates for children are required.

MEDICAL - You will need one year private medical insurance with no copayments from a Spanish company and a medical certificate from your doctor stating that you do not suffer from any recognised disease that may prevent you entering.

APPLICATION FORM - You must submit the 5-page National Visa Application form with glued (not stapled) colour passport photo and Ex-01.

ORIGINAL VALID PASSPORT

CRIMINAL RECORDS CHECK - Certificate that shows if you have been registered in Spain for any type of crime in the last few years. This certificate will need to be translated and apostille-stamped.

“All documents that are not written in Spanish must be officially translated. Once your application is submitted you will receive an answer within one month. Once a favourable reply is received you will get a visa stamp in your passport and can then come to Spain within a maximum of 3 months and start the next step of the process - that of securing your TIE (foreigners residence card). Should your application be declined you can appeal via the courts which is why it is advisable to use an immigration solicitor to make your application.

“This permit can be renewed after one year (apply 60 days before or 90 days after expiry date) or you can apply for a work permit to commence work with a contract or as self-employed. If you are not going to be working then the renewal will be necessary every 2 years until 5 years when you can get a long-term permit allowing you to live here without needing to renew it for 5 years. Because each renewal thereafter is for 2 years (1, 2, 2) after the first year the amount of money you must show in the bank is DOUBLED so €51,632 plus double for your spouse and each family member. During the first 5 years you must reside at least 6 months per year in Spain.

“BREXPATS IN SPAIN has the experts to help you with all of this  - criminal checks, medical insurance, completion of application, official translations, submission and appeal, if needs be, and we will be here to take you through the next step of the process.”

I would add note - "if" you want to get permanent residence at the 5 year mark , it is my understanding you cannot be out of Spain for more than a total of ten months during the first qualifying five years - ( the Brexpats statement is a little misleading on that ) .

I would also mention the "remote working" aspect , from experience in USA , all consulates ( in the US ) now will not permit any form of remote working to support an application for NLV , of course it happens but folks do not highlight it as a means of showing support. ( It is not illegal to remote work from Spain it is simply a condition Spanish Consulates will not permit when applying ! )

My understanding is that the NLV only forbids you to work for a company based in Spain or that has a legal entity in Spain. So you can work for a foreign company as long as it isn't a foreign company based *in* Spain.

Chrisso - I agree legally your interpretation is correct as far as I understand it , BUT- the issue many have is the individual consulates determine their own requirements and as I mentioned in USA they will not allow remote working and some have even required an affidavit to that effect !  Lets hope the consulates in the UK are more reasonable !!

Another fun one in L.A you cannot have a mortgage !!  People with property with a mortgage have been refused NLV only due to having mortgage ( even though property rented out ) no where in any form can anyone I know find where that is prohibited but in one consulate it is !

:-)

If it helps I can recommend http://www.apostille.biz/ to do your Apostille of neccessary documents.  It is a fabulous service, reasonably priced and can be done online

Hi

The information on this subject and subsequent answers is very informative and much appreciated, however I find it confusing in parts.

Does anyone have the answer to this question please . . . . .

The required documents (Non Lucrative Visa / Police Disclosure Certificate /        Medical Questionnaire) etc do they all have to be translated from English to Spanish?

Can The Hague Apostille translate these documents then stamp them?  If not could anyone recommend a company I can send these documents to for translation into Spanish?

I look forward to your help (I’m finding it a bit daunting to be honest)

Regards

Annie

Yes, any document not in Spanish MUST be translated.

Yes, the company I specified above (apostille.biz) can translate AND apostille documentation that is accepted by Spanish authorities.  I used them myself for just such a service  (accepted here at Extranjeria in Almería and they are very VERY picky!!).

No, I live in Spain. And not sending anyone my email address or tel number 😏

You would need to consult a gestor here in Almeria to find out charges involved.

Good Morning

Thank you for your reply.  Do you have any knowledge on the following please.

Once again during my research I found one bit of information was frequently challenged by another, I can understand this is probably because we are only some 2 months Post Brexit and even the Embassy are not 100% however this is my question.

Am I correct in thinking that once I gather all of the information and send to the Apostille for translation they put their stamp on that paperwork it is then only VALID for 3 months.  If I don’t have somewhere to live in Spain after 3 months the paperwork has all got to be submitted again?

I look forward to any information you can give on this question

Regards

Annie

Hi Brenver

That’s my next challenge :-).        I’ve requested a couple of quotes online an£ to be honest they are coming back quite expensive - that is possibly /probably due to my age (61) - I’ll let you know once I sit down and concentrate on that subject.  If you find anything useful I would be grateful if you would share it

Kind Regards

Annie
