The only discussions held were for the trade agreement between EU and UK; no discussions were held regarding movement of people.  When UK introduced its new points-based immigration system, it also stopped reciprocity of health care via S1.

As stated, those already here prior to 31/12/20 would still be able to get health care via S1 on reaching pensionable age as they are beneficiaries of s18.1 of the withdrawal agreement, which continues the benefits already enjoyed by people already living in an EU country prior to the end of the ...

...transition period.

Arrivals with a UK passport post 31/12 (i.e. from 1/1/21 onwards) are Third Country Nationals and subject to exactly the same requirements as those from America, Australia, South Africa, Russia etc etc.

There are NO “special arrangements” being discussed for UK passport holders.

Even Portugal which is trying to attract UK passport holders by offering a 10 year 10% tax break and lower threshold for minimum income still requires private health insurance.

We advise anyone applying for the visa to check thoroughly this position. We are not of pension age and will buy insurance. This stream is about adding information and help not about stress.

Hence my adding of this information, so people don’t come into this expecting some kind of non-existent special deal and understanding that UK passport holders are in exactly the same boat as any other Third Country National.

If you enter into the migration application with your eyes open and knowing what to expect, there’s a lot less stress than finding out down the track that yes you DO need private health cover etc etc

If you sell a U.K. property after becoming resident in Spain and thereby tax resident here, my understanding is that if you are over 65 and buy a property in Spain then you are not liable for CGT.

Hi. At this time no. I am getting everything together , then I might ask a solicitor to look over it. I’m not really sure what they charge. But as you may be aware there is considerable outlay sorting out all the paperwork without the involvement of a solicitor. The more I do the less I have to pay out to a solicitor.  I will gladly pass on my experiences so far if required

At the moment we are just gathering documents and trying to sort out what we should do with our UK property, and stay in our Mojacar apartment rather than rushing in to a villa..

We don't at this stage plan to go via a solicitor as it seems a practical application you can do yourself. Maybe some running around getting docs translated and finding a Solicitor with the Hague stamp, but doable. Although if you do go via a solicitor it may cut out some stress. Some people on here are further on than we are so as time goes by we will all find out a lot more. We have been in contact with our Spanish solicitor who has offered advice and translation facilities. The only thing is you personally have to go to the embassy in the UK anyway to process the forms. We may email forms to our Spanish solicitor for checking but not sure yet. They have offered their assistance.

It's safe to say plenty of UK citizens are now, out of necessity, applying for many different types of visas for Europe, so what we fear and perceive as being difficult and long winded will just become a formality in time for Brits. This has always been the case for 3rd countries

Good luck everyone.

Information on the NLV from Brexpats -

“Those of you who do not qualify for residency here in Spain under the Withdrawal Agreement are considering the Non Lucrative Visa but what is it exactly and how do you apply for it?

“The Non Lucrative Visa (NLV) is a residency permit that will enable you to stay for ONE year in the first instance but this can be renewed. It is for those who will not be working here during that first year so possibly retiring here and I have heard it also referred to as the ‘Retirement Visa’.  It would also be applicable to those who can work here remotely with the UK or those who want to study or be on an internship here.

“All applications must be made to the Spanish Consulate in your country of origin.

FINANCIAL STATUS - You need to submit evidence of your financial status to prove that you will not become a financial burden on Spain, usually by means of the previous 6 months bank statements in your name. Currently for the first year this will be €25,816 pa in the bank for a single application and with an extra €6,454 for the spouse and for each child under the legal age (unless they are proven as your dependants). This doesn’t have to be all in the same bank and can be split in UK and Spanish bank accounts but must equate to a minimum of these amounts. Proof of relationship to spouse (marriage certificate or common law document) and birth certificates for children are required.

MEDICAL - You will need one year private medical insurance with no copayments from a Spanish company and a medical certificate from your doctor stating that you do not suffer from any recognised disease that may prevent you entering.

APPLICATION FORM - You must submit the 5-page National Visa Application form with glued (not stapled) colour passport photo and Ex-01.

ORIGINAL VALID PASSPORT

CRIMINAL RECORDS CHECK - Certificate that shows if you have been registered in Spain for any type of crime in the last few years. This certificate will need to be translated and apostille-stamped.

“All documents that are not written in Spanish must be officially translated. Once your application is submitted you will receive an answer within one month. Once a favourable reply is received you will get a visa stamp in your passport and can then come to Spain within a maximum of 3 months and start the next step of the process - that of securing your TIE (foreigners residence card). Should your application be declined you can appeal via the courts which is why it is advisable to use an immigration solicitor to make your application.

“This permit can be renewed after one year (apply 60 days before or 90 days after expiry date) or you can apply for a work permit to commence work with a contract or as self-employed. If you are not going to be working then the renewal will be necessary every 2 years until 5 years when you can get a long-term permit allowing you to live here without needing to renew it for 5 years. Because each renewal thereafter is for 2 years (1, 2, 2) after the first year the amount of money you must show in the bank is DOUBLED so €51,632 plus double for your spouse and each family member. During the first 5 years you must reside at least 6 months per year in Spain.

“BREXPATS IN SPAIN has the experts to help you with all of this  - criminal checks, medical insurance, completion of application, official translations, submission and appeal, if needs be, and we will be here to take you through the next step of the process.”
