Noisy and Filthy Aviary and other Quality of Life Health Issues

I'm looking for a bit advice. Tried CAB didn't get a reply ? In April I moved into my new home and noticed my neighbour has an Aviary, about 10' from my bedroom window, with about 20 exotic birds. He also has a seperate compound with about 4 chickens in both of which are filthy As soon as I moved in I spoke to the neighbour to tell him about the smell to which he stated he would clean it, he hasn't. He then bought a parakeet which squawks very loudly from around 5 in the morning, I researched Parakeets and the reason is that in there natural habitat mates could be up to 2kms away hence they Squawk Very Loudly. I asked the neighbours wife if they could take steps to quieten it and suggested isolating the bird through the night in a cage covered over and release it back into the Aviary during the day to which she replied I'll ask my husband, and did nothing. So my dilemma is who can I report the stink, filth and noise and general health issues (rats) to They also have a palm tree up against our adjoining fence and adjacent to the Aviary and every night with my torch I watch the rats scurrying up and down eating the seeds, my neighbour said they're cats !!! Any sensible (legal) advice would be appreciated 👍

You could try CATS at Zurgena, they might be able to point you in the right direction re who to complain too. Or try your town hall. Do you have any other neighbours that might join you in your quest.

Thanks for the reply Jenni unfortunately I have 2 very elderly Spanish and 2 very elderly English neighbours who i wouldn't want to involve, they may well have there own issues to deal with ! I tried CATs but got no reply to a message on there site. Do you know where the CAT office in Zurgena a simple Environmental visit would definitely prompt some official action again unfortunately that photo doesn't even begin to show the true state of there place. I do believe in each to there own unless it impacts on others and to add insult I forgot to mention thete 3 barking dogs 🤷‍♂️🤦‍♂️

Hi Will,

Are we talking about the same organisation. in your original post you say you didn't get any reply from CAB (citizen advice). I am suggesting CATS, which is completely different, CATS is in Zurgena/Alfoquia. its a large office and they offer all sorts of help. Its along the main road. Ask anyone in that area and they will be sure to point you in the right direction. Hope you get it sorted.  What nationality are the people with the birds, just thinking there might be a lanuage problem and they dont understand your concern.

CATs ? I've only recently moved to Spain so I am the proverbial fish out of water, do they speak English ? My neighbours are southerners sound Essex ish, and I'm a Geordie so probably a bit of a language issue 😊

Yes Will63 they all speak English. Its run by English, and they will be open tomorrow 10-2 is the norm. Good luck

Will63, You have my greatest sympathy. You're about to fight one hell of a battle that you will lose. I agree with every word you say, but when birds/animals are involved there are many who will take the side of the animals (especially dogs and cats) and not care a whit about you or even your well-being. Don't be lured into believing all you hear even from some of the posters on this thread because with them it is always the animals/birds  that will come first.

The dogs are barking. I note (and don't blame you) that this was added after the aviary and rats issues. Perhaps you're wiser than what I am giving you credit for?  Your uncaring neighbour cannot tell the difference between cats and rats - Give me a Break!. And your neighbour won't even clean up his yard!

Here's My Advice:- (a) Use your phone/camera/video-device to film what is going on. Record the noise too. You can never have too much evidence. If you feel any way threatened go to the police station and report the matter. (b) Talk to your neighbours as some of them are probably of the same opinion as you. The more support you get, the better.

Going to an animal organisation that is there for the protection of all things animal is useless as they have no interest in your situation. All you'll be doing is giving them ammunition for them to shoot you with.

If you don't believe me have a look at other threads on this forum regarding uncontrolled dogs, feral cats and so-called animal lovers. Incidentally, I own two dogs and I am in full control of them at all times and exercise them every day where it is legal.  I don't inflict my dogs on others.

Also, don't be surprised if some contributors here will want this thread (or part of) deleted.

If it is apparent the birds are being mistreated or kept in conditions injurious or harmful to their health, then the people to contact will be SEPRONA, the division of Guardia Civil tasked with animal welfare.  They are very VERY proactive, more so now that Spain has introduced some very proactive animal protection laws.  I imagine CATS services will advise you to contact SEPRONA in this case.

If the issue is solely with the noise, *and not the conditions*, you may receive little sympathy from the Ayuntamiento who will likely remind you that you chose to live there, with the birds already being there.  However, from your post, I believe you are concerned about the conditions the birds are kept in, so SEPRONA may be the way to go.
