Hello,

I have several legal problems arising out of moving here and living on an urbanisation with poor administration. One matter has become urgent and I need a good solicitor - not a property conveyancer?

I have not been able to pay my monthly fees because the solicitor /administrator can not tell me the correct figures for me to pay. It was not arranged at the beginning because my solicitor cocked up on several technicalities.

This administrator sent me a spreadsheet where every total was wrong and tried to charge me for pre ownership months. He admitted his mistake but I am now several months asking and waiting,

I have now owned the property for a year, so the matter is urgent as I am sure this administrator is willing to sell my property as I am in default and I have been giving him some serious grief about lack of information I am entitled to under the Horizontal Titles Act governing shared property ownership.

The solicitor does not have to be local - just in Spain somewhere to apply leverage on my side?

Gesisur is a company we used, originally in Aguilas. Lawyer was Jose Carillo, I think they have an office in Vera Playa?

Tthe offices are in San Juan de Terreos and Aguilas local to me in Palomares but they have several other offices in Heurcal etc ...

and I have written to them...

Promised an update...

After a few days of communication with Gesisur - after initial enthusiasm from them, the lawyer who responded was the same as all the others and basically is reluctant or downright refuses to deal with the problem. In fact they will talk the issue down until you are the problem not the lawyer. It is a common isssue here that Spanish people will avoid any trouble rather than deal with it in some way.

I have found the Spanish very helpful when you have problems because they know how to get round them but when it comes to any authority or legal matter their backs turn to you.

The association of solicitors in Madrid has a website asking if you have had problems with a solicitor (in English), which I used. After two months the matter was referred back to me and I have to submit it to my local association -Almeria, Malaga etc.

My uptake on this is that solicitors do not like to lose their reputation and will deal with each other behind closed doors to remind them not to lose that reputation but we are expecting the 'police' to police themselves.

If you ever want to understand how corruption works this is one of the working elements. The field is wide open then for any solicitor to behave incorrectly without recall to any law. Only if the other lawyers get upset is there likely to be any  retribution?

I am currently preparing to refer this to the Ministry of Justice in Madrid but have to register first before being able to complain or make recommendations on their site - they definitely want to know who I am and where to send the .......  :)

If we had a credible government in the UK (that was respected by Spain), we would have proper representation here but currently we have no legitimate leverage due to the ongoing reverberations of Brexit and later we will only be an external EU force.

I have wriitten to the EU about the situation too.

I won't be siting and waiting for any solutions. However, if something good does happen, I will post it here.

Thanks, I can give it a go. I have nothing to lose.... that I am not already in danger of losing! :)

Update to this saga for anyone following it.

I have paid twelve months after getting some figures and an anonymous bank account.

Now the administrator tells me he has given me the wrong amount for the third time and seven months of asking. It is only 20 cents a month difference but already I am in arrears. Your voting rights in issues like this are removed if you are in debt....

My advice on issues like this is to go public, to name and shame. Once they start to lose business or bring the profession into some kind of disrepute they may have an influence greater than your own because you have no avenue to go to court against a solicitor and a language barrier too?

Well, more of the same

After writing a calm and sensible email to Gerardo Vasquez and explaining to a lawyer the points oflaw that solicitors have failed at (3 solicitors and four problems) I have had to explain to him a second time what those problems are - clear and unambiguous failures by solicitors.

That his lack of seeing any problem is indicative of two things. One is that this happens all the time and is nothing for solicitors to get involved in and that there is a real fear amongst them about acting against another lawyer if you did have a real problem.

For what it is worth....

I had wondered why so many lawyers in Spain had spent time in the UK. There are the obvious things about speaking English well when so many English speakers provide business and it sounds encouraging that they have seen a different legal system, for the good bad and contrasts to their own. However, I do not think the system of operation here has benefitted and is still rooted in the world of family connections and reputation above product? Yes, I know many solicitors here get a good reputation from buyers because everything goes well and homes are transacted successfully but when something goes wrong, the train comes off the track.

If anyone follows this thread I would love to hear from someone who has had a solicitor deal with  a serious home conveyancing problem?
