I THINK that as you are already S1 holders in France, you already benefit from the Withdrawal Agreement, although I understand that France isn’t so big on giving written recognition in the form of a card or certificate.

My understanding is that yes, you could arrive and apply for Residencia, having until 30/6/2021 to do that, and if it doesn’t suit you, as you were previously already covered under the WA, you could go back to France ... I admit I’m on shaky ground here, but that is how I understand this will...

... work.  The fact you have already registered S1 in France puts you streets ahead.

Please also note that any time spent as a legal resident of France will be counted towards the 5 years necessary to be recognised as a permanent resident here.

Hi Dario thank you for your prompt reply.
I suppose in a nutshell I am hoping that I don’t have to inform France that I have left the country for good until I am an officially documented resident in Spain. As soon as I ask the U.K. for an S1 with a Spanish address I have burned my bridges with France because I would have to re-apply for residence with them and no  reciprocal health care would be a available.

Ooh, that’s a difficult position to be in. With so much riding on the answers I think you really need to consult with someone who specialises in the intricacies of the withdrawal agreement! Possibly losing your healthcare and your current French residency are huge concerns, I don't think I’d like to even suggest how you approach that or what your situation might be.

Thank you Beannie1

I don’t want to anything dodgy -I need to sleep at night !

I suppose we just have to be sure that we want to stay in Spain when we apply for our Spanish S1s. Before Brexit it was oh so simple -bought a holiday home in France and then decided to retire there but France is so expensive now.........

If he becomes resident in Spain after 31st December 2020 he will not be able to have reciprocal healthcare using an S1. Please see Dario’s post on page 1 of this thread.

Hi

If your husband has doubts about whether he would pass a Spanish medical to drive its highly unlikely that he would pass a British medical.

And if he has doubts about whether he would pass a British medical even though he might not be due to take a medical it is the responsibility of drivers to be in fit state to drive. If he has ANY doubt he should seek the advice of a doctor.

regards,

Hi Bobby

This link will give you some idea about Residencia. If you register here on the Padron before 31st Dec 2020 you then have until 30th June 2020 to finalise all the documentation.

Residency

Hope this helps a little

regards,

Hi,

With reference to the Padrón, how long does this last? I registered in February this year as had my UK vehicle transferred to Spanish (Matriculation) and in order to do this I registered at the town hall for the Padrón. I own an apartment (my name only, also have a Spanish bank account, again, my name only) my husband and 19yr old son wish to apply for residency.  Will this Padrón from February be sufficient to apply for residency? Can my spouse and son use my details to apply too?

Sorry if this sounds long-winded!!

Regards,

DarioMartin

For anything official and especially Residencia, you will require a Certificado de Empadronamiento less than 3 months old.

This is just a matter of going to Ayuntamiento and asking for a new Certificado

Thanks everyone for replies. Not sure we could rent out there before we sell. Selling the house during the current pandemic is tricky and those that may want to purchase are themselves isolating. Getting a buyer to complete before xmas is unlikely. We should have thought this through sooner.

It’s possible to rent out here and rent out your own house in the U.K. Sell it at a later date once you know where/what you wish to buy out here

That is what we did at any rate. We engaged a Lettings Agent who manage the rental, vetted the tenants and make regular checks, etc. It has worked well for us for 2 years.
