Ummmmm ..... I think it is up to 5 years you can remain outside if you have Residencia Pemanente.  Permanent residence is gained automatically after you have had 5 years of legal residency.  What period you can stay away with residency only as an EU Cituzen with less than 5 years legal residency I really don’t know.

Just quietly, I think this whole Brexit thing is a bit of a mess ......

Dario is spot on. Re staying over 3 months, yes as motorhome travellers this is often overstayed, some people fly back for a weekend , thinking this allows an extention, wrong, the stay is limited to 90 days in 180 day period. We get away with it the same way as europeans work in England, the rules are not followed through. This could well change after a no deal brexit, as a fine could be generated for overstaying 90 days.

You are so right Dario. Brexit makes our country look so stupid and  being advised by numbskulls.  I wonder though how other countries would do I’d.   Prob just the same .  People’s ratification needed.

Dario do you have to change driving licence to Spanish if you take residencia just to be in Spain 6 months a year but  stay tax resident in U.K. ? Also, I have heard taking residencia means tax resident too.  We don’t want to do that. Do we also have to put money into our Spanish bank if we don’t live in Spain.?   Our accounts in our two Spanish banks are non Resident. Thanks for taking the time to write all these posts it’s much aprecia

Taking questions one at a time :- Driving licence - that’s a good question.  Generally you have to change your licence if you’ve taken Residencia - Guardia Civil CAN fine you if your license isn’t changed.  I know of one or two posts on this site highlighting that, but others have said that they continue here with uk licences with no issue.  Once again, post Brexit it’s anybodies guess as to what will happen.  I guess if UK is your country of TAX residency, then you would be sensible to keep a UK licence - but I really stand to correction on that.

Residencia is different to Tax Residency.  Residencia is obligatory if you spend more than 90 days in Spain - TAX Residency becomes necessary if you are here for more than 183 days a year.  You are not deemed Tax Resident here until and unless HMRC are advised that you are resident in Spain for tax purposes.  Residencia does not trigger that.

As to banks, you are not obliged to keep all your money in them.  If and when you obtain Residencia, you can change your account to a residents account which may bring about lower taxes etc on the account, as well as other benefits only available to residents.

Just a query. My understanding is that you cannot be resident in more than one country. So if you obtain residency here in Spain you cannot also be resident in the U.K. That is my impression anyway, via the info on the CAB (Spain) site. 

Tax residency is different. I live in Spain all year but my income emanating from the U.K. is taxed by HMRC in the U.K. I also have to submit a tax return here in Spain but because of the ‘double taxation’ rule I don’t pay tax twice on the same income.

In response to Dario and question of how long allowed outside Spain when having a temporary residency :

Did some research - and results are conflicting !  ( why that is not a surprise ! ). 

For temporary residents ( i.e. not permanent ) 6months out of a year - but the kicker comes when application for permanent comes up - not more than 10 months in 5 years....

I think this question will stand some more investigation , but after permanent resident awarded appears much clearer !
