I am in the process of applying for NIE in order to open bank account etc.  My agent has just advised me that the EHIC 111 is now no longer acceptable due to Brexit, and you now need Spanish Health Insurance.  Im currently renting with a view to buying, but i also work from home for a UK company.  

Any advice or updated information please?

You dont need a NIE to open a bank account.

But when you do apply for NIE you need to do residence at same time and you need proof of income €5300 per year private heath care.

Pardon and long term rental contract more than 6 months.

We have just done ours in 6 weeks

Hi, 

Thanks but I don't fully understand what you say   'Pardon and long term rental contract more than 6 months.'

I have registered with Town Hall for... Padron, so then I don't need NIE for bank account, and I intend to rent for more than 6 months.

Can you explain please?

For bank account you just your ID and national insurance number.

All the rest is to get NIE and residency

The E111 (EHIC card now) is still acceptable and may change in the future because of Brexit but if you get one now (free - you can apply online) it will probably still be valid until it expires or if the real terms of Brexit say differently. 

It's still well worth getting one and your agent is NOT correct when he says EHIC is 'now no longer acceptable due to Brexit.

Don't believe everything Agents tell you without checking the info out independently yourself...whatever it is, if it is important to you. Like 'you can walk to the shops from here'...'The bars and restaurants are walkable'. These are the good ones they often tell us. Best check everything out yourself.

If you intend to spend more than 90 days in Spain, Residencia is mandatory.  Your UK passport at the moment allows a stay of up to 3 months,

To obtain Residencia, you will require Padrón from Ayuntamiento that is no more than 2 months old - 1 month is better.  You will also require either proof of income, be that from a Spanish job, a Rental income from overseas or a Pension or proof by Certificate from a Spanish bank of an annual average balance of 9.750,00 € per person applying in a Spanish bank.  You will also need proof of health insurance, either private, by way of pension (S1 form I think that is) or by self employment and payment of Autónomo and therefore access to Spanish health care.

I’ve helped a few people through Residencia, my last trip to Almería was week before last, so I can verify the above as accurate

Dario thank you. My main point is that is there a requirement for just NIE to have health insurance,  as UK E111 card has been accepted before? I have had conflicting answers as to whether NIE is required to open non-residential bank account.

Also I have 2 friends over here  one has been here for 12 years, the other person for 8 years, neither have residencia.

I don't think that you are correct about passport allowing only a 3 month stay, I could travel any European country and travel in that country by motor home for example for as long as I wanted to as things stand pre-Vrexit.

Where to start .... OK.  Your friends who live in Spain without Residencia are, for a variety of reasons, going to find things a little more difficult for them after March next year.  That much is certain.  

With regards UK passport (currently) only allowing a 3 month stay, as much as it is a bitter pill to swallow for many, I can assure you I am correct.  Like I say, I've helped quite a few people through the Residencia process and have got to know the ins and outs.  At the moment, the Spanish authorities turn a bit of a blind eye to overstays by UK nationals - that is going to change.  Still, perhaps better not to take my word - this UK Government site gives a much clearer explanation of current residency requirements : https://www.gov.uk/guidance/residency-requirements-in-spain#residency-requirements  Please bear in mind that after March 29 next year, that will change and UK nationals will not be able to register as an EU citizen, but will likely have to make application for permanent residency.

I can certainly attest that as of now you do not need a NIE to open a Non Residents bank account.  Just a passport.  Again, I have been into the bank with two other people who have done this.  I myself opened my Bank Account here in 2014 with my passport.

The main thrust of your question though is about the EHIC card - the E111.  This is not in any way tied to NIE.  A NIE is Número de Identificación Extranjero - foreigners identity number and is a financial requirement.  The EHIC is ONLY valid if you are holidaying in the country.  If you take up residence as outlined above (i.e. staying for more than 3 months) then your EHIC card will not be accepted.  In that case you need either Private Health Cover or acceptance onto Spanish Health System by use of S1(??) form from UK or payment of Autónomo (through either being employed or self-employed)

The short version is this:- 

If you make a major purchase here (car, house etc etc) you will need a NIE

If you are holidaying in Spain, i.e. spending less that 90 days, then you can use your EHIC card should the need arise and will not need a NIE.

If you take up Residency i.e. spend more than 90 days here as outlined above, you must register at the Ayuntamiento for your Padrón, and apply for Residencia; Residencia will give you your NIE
