Understood - I suspect in law that appearance on the pardon is not fiscal residence under the double taxation treaties, but that doesn’t stop the Spanish authorities from arguing something different.  A little thing like law doesn’t normally stop them!

Exactly.

Sounding hopeful, although I have to admit I’ve given up on the digital certificate for myself, despite being reasonably good on techie stuff!  Did HMRC stop deducting tax as soon as you sent them the certificate of fiscal residence so the delay was just about deducting back tax paid, or d...

...id they mess you about on both elements?

No. I'm still paying double ☹️. It takes a long time post Covid

It’s not to bad if you get the right person to do it for you.Which in our case I didn’t.l eventually found a lady in the town l live in,Who gave me the the right forms booked a appointment at the tax office.Who keep them a day or so.Then l collected them which are stamped, returned them to England who received them December 2021 .Got all my tax l had paid in August this year plus No tax being taken from England now.

Oh God - the excuse for everything!  I’d be looking at lodging a complaint with the adjudicator - the HMRC version of an Ombudsman - although they’re probably pretty swamped.  However when I was dealing with local authorities in my working life, I usually found an Ombudsman complaint reached the parts other complaints couldn’t!  Local authorities detested them because it just caused them even more work they couldn’t do.

Hi there

I have recently done this also. Obtaining the certificate from my accountant in Spain was easy and took about a week. Dealing with the HMRC was a different matter and it took them almost 18 months to action the certificate of tax residency, then took another 18 months (and constant chasing) to get them to refund the tax I had paid in the UK and should not have done.

Hope that helps

Thank the lord I never bought a property which I nearly did in 2007 , phew . Much easier doing long term rentals for me and dodge the summer crowds and heat . Good luck , it sounds a nightmare .
