Hello 

My name is Phil Cook and i live in Mojacar. i am semi retired so still work and draw a wage from the UK as well as a UK pension.

I have to pay my taxes in the UK each month. Then pay my tax again here in Spain which i have sorted.

Can any one help me please by recommending a good accountancy company within the UK who can help me claim these tax monies back, that i have paid to HMRC. As i am struggling to find a company who will help me.

I may be on the wrong track here, but double taxation agreement means that any tax paid in UK will not be paid here, and you need a good asesor here to ensure that tax already paid in the UK is not deducted here (only deduction may be the difference between what you paid in the UK and what you would have paid here)

Agree the Spanish accountant should be taking the UK tax into account when submitting tax declaration here and then only tax on the part for Spain will be calculated here.   No need for two seperate accountants bills!

I am a retired accountant.  You shouldn't need an accountant in the UK.  Keep all your UK information and your accountant in Spain should be taking that into account when (s)he returns your total income from all sources to the Spanish authorities.  (S)he should also check your personal circumstances, code numbers if any, etc. to see that the tax deducted in the UK is correct in the first place.  Relief for tax suffered in the UK will be given as Alicia 11 says above.

At the end of first tax year accounts your Spanish accountant or Gestor can obtain a form from the Spanish tax authorities.  You submit this to UK and you claim back any tax paid in UK (as will also have been taxed in that year in Spain).   The following year you only pay tax in Spain and not in UK.  There are some exceptions.  A good Spanish tax accountant will be able to advise about these.

Phil. As you live in Mojacar, call Indalo Partners at the Parque Comercial. You should initially go non-resident in UK to obtain a Zero tax code. Then Indalo will obtain a Fiscal certificate of tax residency in Spain, and process your claim with HMRC. It gets difficult claiming back tax from UK if over 4 years ago. However it is done , you should not be liable for double taxation if you have a TIE in Spain. 

If you are still resident in UK, DO NOT sign on to local padron. You will however be liable for a small non-resident tax here if you are on 90-day rule for holiday home owner for example.

Here is a link to calculate your tax liability when resident in Spain. Use the 'advanced' button to input your age, and circumstances, earnings etc. This is quite accurate. For 2021 use £1 = €1.16 exchange

ll your earnings, even eg if ex-military or govt service pension already taxed in uk MUST be declared in Spain, usually around April/May for previous calendar year. Worldwide assets should also be declared here on a modelo 720 (shares/investments, accounts, or property worth more than €50k each).  Failure to do so if you are already registered on local padron, and have NIE & TIE proving Sp residency, can (and does) fall foul of Hacienda rules, resulting in heavy fines. Talk to Indalo Partners they can sort you out.

Hope this helps you get your back-tax like I had to do.

Hi Dario

I think that you are incorrect o this occasion. I have just this week completed my first Spanish tax return (for 2021) and my gestor informs me that I need to pay the full amount of tax calculated under Spanish tax authority rates, even though I also paid the UK tax throughout 2021. The required double taxation form requesting a refund of the tax paid in the UK from HMRC was submitted in December 2021 and despite repeated telephone requests on my part the refund has yet to be processed although HMRC has confirmed receipt at least! There appears to be a significant delay in dealing with refunds and I have been informed that it may be July before I can expect any progress. In the meantime I continue to pay UK tax on my pensions in 2022 and I will pay the first installment of my 2021 Spanish tax on the 30th of June followed by a second payment in November.

It would be interesting to know if anyone else is suffering the same financial inconvenience?

I am resident in Ireland but have pensions in the U.K.- it took about 18 months after submitting the form to HMRC before I received my tax rebate and then in the next tax year I received a ‘no tax’ rating on my pensions
