Absolutely agree, and that was my reason for encouraging you to speak to a really good Immigration lawyer who could develop a unique understanding of your needs.

As the writer explained perfectly, this is an entirely different landscape from simply buying a property and the intention to run a business here, especially post Brexit. ...

...

I also fully agree that you will find that you will need to support your ambitions with a viable Business Plan, proof of funding etc.

This is why I would encourage you to at least include a consultation with a large City Law Firm who have substantial experience and are able to give you reassuring advice, even if you decide to engage a local lawyer eventually for whatever reason.

I would suggest that you owe it to yourself to be really well informed to make good choices.

My reasoning for specifying Mundi, is that whilst not a Big City law firm (who charge big city prices even for consultation), Mundi specialize in migration and talk to Extranjería on an almost daily basis and so are completely up to date with current requirements.

Another reason for preferring a local firm over big city is that requirements vary between the autonomous communities, so advice given by say, a firm in Madrid, which is in the autonomous community of Madrid, may not be wholly accurate for people moving to Mojácar which is in the autonomous community of Andalucia

You could of course pick a firm in Almeria, Granada, Malaga etc … but again different Oficinas de Extranjería in different provinces within the same autonomous communities tend to have different requirements … Spain!!

Than you for all the advice !

I totally agree that you need a legal advice before you starting this journey. The unknown can be scary , especially  if you don’t speck the language. My partner is a British citizen and I have European passport, I’m assuming it will be an easier process for me ?

Thanks

For you it’s no problem at all - you have freedom of movement.  You can arrive and immediately apply for Residencia.  If you are married, your partner can apply as a dependent of an EU citizen, sidestepping the necessity for NLV etc.

If you are not married, unfortunately at this point Almeria is one of the Oficina de Extranjerías that doesn’t recognise de-facto relationships so if you were coming to Mojácar, he’d need an NLV.  (Malaga apparently DOES recognise de-facto relationships … however, check with immigration specialist)

Again, I'm erring on the side of practical caution because good legal advice is what you need.

Certainly on a personal level you have an advantage as an EU Passport holder in so much that you have Rights that extend more seamlessly into residency within the EU Than your British partner.

As you describe the second party as your Partner, I assume from that you may not be married. I'd suggest this is a strong reason for that advice. Married couples have to supply a Marriage certificate and have it Apostilled so I expect reassurances of your relationship may be required but this is me drifting into supposition which is the dangerous water I've suggested you avoid rather than being distracted by what generally turns out to be well intentioned opinions rather than solid facts.

In the right legal hands you'll at least know where you stand.

The reason I suggested a city immigration lawyer is because they have the most experience and greater recognition at Immigration. I appreciate others have suggested you are better served locally due to the regional nuances but your Visa is issued by the government office in Madrid or Barcelona not a local regional office. Local advicusfor your business is of course fabulous once you've got the Visa.

Good luck with your adventure!
