Without wanting to get into arguments on this, I do have residencia and had my card on me tucked in with my Irish passport!  So no TIE but showed them the residencia yet they still asked for the NIE form. I’d say that is very very likely ant not uncommon unfortunately.  As an Irish passport holder, your residence card *is* your NIE confirmation - you wouldn’t necessarily have a separate one.

Unfortunately this is all too common, with various funcionarios having their own interpretation of various requirements

Once people reach 5 years and automatically become permanent residents, then yes, on applying for their TIE they will get a 10 year TIE.

Jenni.  It’s been the rule for a great deal longer than 5 years - around 20 years or so now, if not longer, and is in line with the rest of the EU; once you have completed 5 years legal residency, you automatically become a permanent resident.  That isn’t changing, it would require a great deal more than the whim of a funcionario to change it, and there is no benefit to changing it.

...na say its going thru, but as far as Spain is concerned and arrangements between Spain and the UK , well how long is a piece of string.

To apply for your TIE is easy, do it, why are you waiting. Dont you want to be legal in the country that you have chosen to live it?

The TIE is not yet mandatory and my Residencia card is still legal so I am legal and meeting the requirements of the country I have chosen to live in, I also hold a Spanish driving license so again am legal for the country I have chosen to live in.  As and when the TIE becomes a legal requirement I shall then look yo change...

I also have both uk and Irish passports, and did my residency using my Irish passport - which means I can’t have a TIE. My British husband has a TIE and I have the old green card still.

If you haven't already done so it's worth getting your green card laminated, costs very little and helps to protect it for longer...

Yes, thanks! Our gestoria gave us plastic wallets (although you have to put paper between the card and the wallet!) - still looks like new!

Jenni, I think this forum is about helping one another - your attitude, comments and incorrect information based on what you think people should do and what might happen are anything but helpful - could I respectfully suggest that unless you have something helpful and accurate to say then it might be better to just go and have a nice cup of tea than join in and start accusing people of not doing things properly - it’s really quite offensive
