Hi there

We are currently in the middle of organising our permanent move to la alfoquia. 

House in uk sold subject to contract and deposit paid on house in Spain. Our removal company however are insisting on a padron before they can take our stuff. Our Spanish solicitors have power of attorney. 

Any advice regarding the above will be very much appreciated

Your removers are being a bit strange - you cannot get a Padrón until you have taken up residence in a place - a deposit only will not allow you to get a Padrón as Ayuntamiento will require proof of ownership such as deeds.  I don’t think that’s something even a Power of Attorney can sort out

Is it an English-based removal company? If so they might not be aware if the requirements for getting a Padrón - you certainly don’t need one to prove legal entitlement to property

Yes they are an English based company. However they specialise in international removals all over Europe. At first they asked for proof of census? Which turned into a padron. I think they are wrong

They are very wrong.  You’ll need to explain that to get a Padrón you’ll first have to have bought the house because without proof of ownership, they won’t issue a Padrón.

A Padrón is a Certificado de Empadronamiento and each permanent resident of a local council area is obliged to register on the Padrón.  The more people on the Padrón, the more money the Ayuntamiento gets for services.

But a Padrón is a statement that you are residing permanently at that address … difficult to do if you are not there to begin with (as Ayuntamientos often send Policia Local round to check you are where you say you are) and don’t yet own the property

That's what I am finding, they say it's to do with customs. I really appreciate your help and reply

Customs …?  I would have thought a copy of your Visa should be sufficient for customs clearance … have you contacted your Solicitor here?

We are coming under my wife's Irish passport. I have a UK passport but apparently that can all be sorted once there. 

Can I ask you use a removal firm and if do what documents did they need.

I came over way before Brexit happened, so for me it was just a matter of arriving and settling; our non-carry goods came into Almeria airport, then we had them collected and delivered here, had no issues coming in (via Madrid)

yes, your wife can arrive under Freedom of movement and you then register as family member of an EU Citizen

Remember to look at the tax implications if become resident in first half of year.  Would then be liable for CGT on the sale of UK property.
