As I understand it,  the Padron is for those wishing to extend rights such as voting in elections and paying local taxes - a different issue and again something not wanted by many people who live here part time or more than 6 months but not the whole year.

On top of that the UK licence was completely valid until the deadline, now it is not only not equal to a Spanish licence it is treated as though the holder comes from Russia. Doing a full driving test is mean minded and aggressive. The issue is for UK licence holders regardless of their EU nationality or EU rights. More double standards to conjour with. Especially when you consider Spanish nationals are not treated the same way in the UK. Perhaps UK officials have better things to do.

The reason Spain is doing this is because there is a post-Brexit trade deal to be made between the UK and member countries and it is a great opportunity, as others and myself wrote on another thread, for Spain to bring out the Gibraltar Monkey and to try and turn people against the government.

For once I do not believe this is a Brexit issue, as Dario pointed out on a different thread that has been running, only Spain and Italy have taken this course of action, it is not an EU issue. Simply a lack of common sense and a chance to show why Spain will never be a mover and shaker when it comes to international statesmanship. If it thinks the driving licence issue will change the present UK government's mind on Gibraltar it would further show their lack of credible thinking.

As ex-pats from different EU countries said to me..."but if they do this then they can change everything they want to change?" "You will never know if you are going to be hit with the next idea / whim /act of aggression". Bit like living next to Russia?

Have you checked out the private health insurance recently because the old S form and reciprocal health could be next and far more effective at sending people back to the UK.

I heard it’s the fact that Spain wants to make it a simple exchange but they can’t get access to the DVLA just now. So, once the U.K. govt gives the access, they will allow the swap.

Thats pretty much it as I understand.  They require access to DVLA Vehicle information - possibly because of a large amount of still-UK-registered vehicles being driven here.  Without that access they cannot get the status of the vehicle being driven.  Before anyone screams that that is nothing to do with ability to drive, it simply forms an element - a sticking point - of the aforementioned bi-lateral talks.  Equivalence of Gibraltar-issued licences is another bump, but pretty certain that would vanish like smoke in the wind if DVLA access is granted.

I’m always surprised and dismayed by how many people that live in this beautiful, cultured, welcoming country blame it for their own failures. If things are different post brexit, it is because the UK voted to leave the EU. It’s nothing to do with any failure of Spain or the EU. I know it’s an old argument but as a nation we don’t have the right to expect the world to bend to our imperial self belief. I’m staggered how some people living in Spain expect their comfy lives to be unchanged by brexit. If you live in Spain, abide by their laws, or get out and don’t moan about it.

I was simply stating why many people had not signed on the padron and did not want to be considered as Spanish regardless of what bureaucrats would like. The 183 day rule did not change your elected state for paying tax. Yes, I have to file a nil return in Spain but my main tax return is still in the UK where my financial base is mainly based.

It still doesn't address why the Spanish have elected to take this option.

It doesn't address an even simpler solution which, as happened at my residency application my driving licence number was added to my details, as it was again when I imported my car and it was added to the matriculation data. In addition the DTR had no problem issuing me a speeding fine when driving here in a hire car many years ago.

It is a bureaucratic problem 'designed' in Spain that doesn't need to happen.

I swear you either read and don't understand, don't read or more likely simply ignore anything that doesn't fit your worldview.

1. 183 days a year in Spain makes you tax resident here and liable for tax on Worldwide income, whether you like it or not. If you are spending 183 days a year here, filing a nil return here and continuing to pay tax in UK ... that, sir, is what is called tax evasion.  You cannot simply "choose" to pay tax in UK just because that is where your main financial base is.  AEAT would be very very interested to have a chat with you about your reasoning.  If you don't believe me, go see a tax specialist ... and please don't say that you already have and they have advised that what you are doing is OK, because that would be ... misleading ... I think is a nice way to put it.

2.  Padrón.  This is not "something bureaucrats would like you to do", and doing so does not elevate you to "Spanish" - it simply means you acknowledge Spain as your country of primary residence, which if you are spending 183 days a year or more here, it is - and as stated it is the law.  It is not something you actually get given a choice about doing.  If you fail to do it, you are in breach of the laws of this country.  This one though is "just" an administrative offence and covered by a fine. (600€ if I recall)

3.  Spain have not "elected to take this option".  As (now repeatedly) explained, on removing themselves from the EU, Britain also lost all the benefits that went with being a member; licence equivalency being one.  It is then FOR BRITAIN to seek bi-lateral talks, not for Spain to go seeking relief on behalf of the small percentage of British migrants here (yes, small percentage when compared to Romanians, Morrocans and South Americans).

4. PortugalItaly and Spain are yet to sign bi-lateral agreements. It is most definitely NOT a "Spanish problem".  If you believe it is Shay, then, sadly, you are the one with the problem.  You certainly have a tax problem!

Yes, I agree.   I find All Govt departments are using Covid as an excuse. They are so used to not working now !
