Well if you’re applying for Residencia, you’re in Spain, as you cannot apply outside of Spain.  If you have S1, that is your guarantee of health cover - surely you should be able to get treatment in Spain?

EHIC is for neccessary treatment, but you can’t register with a Doctor using EHIC - you should be able to do that with S1 though.  How far through the application process are you?...

...

If you’re still in the UK, then you are still resident there and still covered by NHS

If you visit UK as a Spanish resident after 1/1/21, you will need travel insurance / private health cover as a Spanish issued EHIC will not be valid in UK.

We applying for residenca in a weeks time as had to have a wedding certificate apostile another requirement for residenca.  Then we would have applied and hopefully received S1.  But I thought you can only register the s1 if residenca has been approved not when you have applied.  Both need to be referred to a consultant specialist through a Spanish public doctor. As I have ms and husband had a liver transplant   Not sure how We can do this if waiting for residenca to be approved.  We need to be able to get our meds and both will only have  3 months so very worried.  I read if you have s1 and waitIng for residencia you can use EHIC    Is this true

You can use EHIC up until 31/12/20 for neccessary treatment, but you cannot register with a Doctor using EHIC.  I’m hopeful another S1 beneficiary can answer the question as to when it can be used to present at a Doctor

First, you MUST be in Spain to apply, secondly, you don’t need a NIE - that’s assigned as part of the process.

You will need a Padrón less than 3 months old , valid passport, stamped Modelo 790-052 (proof of payment of gastos), 2 x completed EX20, Colour photo DNI size (32mm x 26mm), proof of health cover and proof of income (an S1 will cover both proof of income and proof of health cover)

I would strongly advise availing yourself of the services of a gestor or abogado to guide you through the process.

All what you have said.   An s1 is for pensioners or if you have exportable benefits Then contact you exportable benefit who will send to Ohsregistration who then post to your Spanish address   Once you have registered this after you have got residencia you will be in the Spanish health system

Although it must be pointed out, OP does NOT first require an NIE to apply for residence - that’s assigned as part of the residence process

Hiya Rosie, I’ll address the time limitation first :- without obtaining Residencia, you may spend a maximum of 90 days in any 180 day period in the Schengen zone, of which Spain is a part.

So Residencia allows you to spend longer than 3 months in Spain (you would need Residencia to be able to spend 6 months in the first place)...

...

To obtain Residencia you must satisfy 4 criteria :-

1) Arrive and begin residing in Spain before 31/12/2020

2) Be incorporated on the Padrón - this is as simple as producing a rental agreement or deeds of a property at the Ayuntamiento and getting a Certificado de Empadronamiento

3) prove you have financial means to support yourself in Spain; this means either showing an income (however derived, be it pension, passive income or whatever) of 5.300€ per annum or showing by means of Certificate in Spanish that you have an annual average bank balance of 9.050€

4) Health cover - either by means of private health insurance, or if you are retired by S1 form from DWP that enables you to use Spanish health system or by being self-employed (or employed on contract) and Autónomo being paid.

These are the big four that you MUST satisfy to obtain Residencia.

Please also bear in mind that once you have Residencia, you are obliged to spend a minimum of 183 days a year in Spain (and so therefore become tax resident as well) to maintain your residency visa.  After 5 years you become a permanent resident and can spend longer continuous periods out of the country if you wish.

I try to impress upon people that Residencia  means residency - you are habitually residing in Spain, it is your primary country of residence; forgive me if you already know this, but too many still see it as a way of having an extended holiday whilst maintaining UK as country of habitual residence.  This is not the case.

As a British citizen, if you go back to the UK for a short while, even though now not “resident” there, you are still entitled to treatment on the NHS.

EDIT 31/8/2020.  I have since learnt that if UK is not your country of habitual residence, then you are in fact NOT entitled to free treatment by NHS.

Hi DarioMartin,

If I can show I have the funds for 10years until I get my pension we I have to prove how much my pension will be in 10years time,

Thank you..

You should ask the person that is applying for you   My person said thus

You need

*valid pasport

*Valid padron (registration with town Hall in spain)

*Proof of income like P60 or pension + officially spanish translated

OR €6500 in a spanish bank account when account on 1 name and €9500 when account on 2 names

We will have an s1 for health.  Will have 10000 saving in account and I transfer 2000 a month but you can transfer less a month I think.

If you arrive prior to 31/12 - no - you have to prove your finances once and once only at the “Residencia” rate of an annual average balance of 9.050€ (“around” because that figure varies from region to region)

After 1/1/21, you’ll need to prove the increased financial requirement (27.000€ per annum) for the entire period of the visa renewal, up to the 5 year point, when you obtain permanent residency.

If you have the funds to cover you for 10 years, then I’d say you’re ok.
