I woudl  like to apply for Residecia but do not have a property, Please let me know what have to do and does it allow me to stay in Spain longer than 6 months, Also are there any sickness benefits ad how d o I go along here and U>K>  if I return to U.K>. for a short time  - can I use   their medical services

Sorry you post is a little complicated to read. So in order to answer your questions I think a few need to be asked.

1. Are you living here now?

2. Are you receiving state pension from the UK?

3. Do you receive sickness benefit in the UK?

4. Are you asking if you can receive sickness benefit here?

5. Why would you need medical cover in the UK on your return?

Hiya Rosie, I’ll address the time limitation first :- without obtaining Residencia, you may spend a maximum of 90 days in any 180 day period in the Schengen zone, of which Spain is a part.

So Residencia allows you to spend longer than 3 months in Spain (you would need Residencia to be able to spend 6 months in the first place)

To obtain Residencia you must satisfy 4 criteria :-

1) Arrive and begin residing in Spain before 31/12/2020

2) Be incorporated on the Padrón - this is as simple as producing a rental agreement or deeds of a property at the Ayuntamiento and getting a Certificado de Empadronamiento 

3) prove you have financial means to support yourself in Spain; this means either showing an income (however derived, be it pension, passive income or whatever) of 5.300€ per annum or showing by means of Certificate in Spanish that you have an annual average bank balance of 9.050€

4) Health cover - either by means of private health insurance, or if you are retired by S1 form from DWP that enables you to use Spanish health system or by being self-employed (or employed on contract) and Autónomo being paid.

These are the big four that you MUST satisfy to obtain Residencia.

Please also bear in mind that once you have Residencia, you are obliged to spend a minimum of 183 days a year in Spain (and so therefore become tax resident as well) to maintain your residency visa.  After 5 years you become a permanent resident and can spend longer continuous periods out of the country if you wish.

I try to impress upon people that Residencia  means residency - you are habitually residing in Spain, it is your primary country of residence; forgive me if you already know this, but too many still see it as a way of having an extended holiday whilst maintaining UK as country of habitual residence.  This is not the case.

As a British citizen, if you go back to the UK for a short while, even though now not “resident” there, you are still entitled to treatment on the NHS.

EDIT 31/8/2020.  I have since learnt that if UK is not your country of habitual residence, then you are in fact NOT entitled to free treatment by NHS.

Hi.all bit confused. One person quoted if you get residenca in Spain and still a british citizen you can still get Nhs treatment when you visit Uk   But someone else’said if you get residencia Spain you can’t  get Nhs treatment when you visit Uk.

So if you become unwell In Uk what do you do? We applying for residencia getting an s1 no retired through health hubby had a liver transplant.  Can we register with a public doctor with EHIC For now so we can be referred to a liver consultant so we can get his meds from a chemist.  He cant be mid transition with no medication.  Not sure who should supply meds and how if we can’t register s1 yet while waiting for residencia.

Well if you’re applying for Residencia, you’re in Spain, as you cannot apply outside of Spain.  If you have S1, that is your guarantee of health cover - surely you should be able to get treatment in Spain?

EHIC is for neccessary treatment, but you can’t register with a Doctor using EHIC - you should be able to do that with S1 though.  How far through the application process are you?

If you’re still in the UK, then you are still resident there and still covered by NHS

If you visit UK as a Spanish resident after 1/1/21, you will need travel insurance / private health cover as a Spanish issued EHIC will not be valid in UK.
