Some estate agents will be more transparent regarding legality of all aspects of a property than others. I found Andrea at Dream Homes Almeria to be completely up front about anything which may not be completely legal. Others were not always so transparent.
a lot of villas in Arboleas have AFOs which give them legality but restrict the future building prospects for improvements.
Check and double check with everyone you can talk with neighbours if possible to get the history of a place and just get a good lawyer, in the past they were the ones who assured their clients that there were no problems with the illegal properties that they all ended up buying.
Remember, when you buy the property you buy into the debts it has.
