Court appearance in Scotland

I've been told I will need to attend court in Scotland in July as a witness. I am currently in the process of getting residency. My concern is that I will not be allowed back into Spain as I have not yet received an NIE. Also of concern is if my appointment for fingerprints etc comes through while im in the UK as with quarantine etc I may be away for a while.

I would contact the court and see if they are using zoom for their proceedings.  Of course it may depend on what capacity you are attending court in?? šŸ¤”šŸ¤”Regards Karen

As Karen has said  depending on the case. If it is criminal law within a crown court you will be required to attend if fingerprints are part of the evidence. Court hearings are at a long backlog  due to the virus hence an adjournment would be almost out of the question if I were you I would consult a Spanish lawyer and explain your situation. He or She could explain your mitigated circumstances regarding your residency. Best of luck.

I've asked that and was told it would not be allowed

Oh goodness what a dilemma for you. If you are using a gestor here, could you explain to them and ask whether they can find out a likely time line for your application? My gestoria here seems to have a good idea of when things will happen as she has lots of TIEs in the system and is at extranjera at least a couple of times a week with clients.

July is still a while away, but of course it feels very stressful to even contemplate having to leave the country without the TIE in these times. It must be worth asking if there's anything your gestor can do to expedite (perhaps with a copy of any correspondence you have from the UK  court)
