Villa in Spain - 8 replies

Motormike Posted by Motormike in General property discussion in Almería on Wed Mar 6, 2019 10:47am

We bought a villa 2 years ago in Andalusia, Chercos, a lovely villa in a very nice area close to the pretty town of Chercos, 15 minutes from Machael the area famous for the marble. We used a recommended local solicitor who assured us the villa although built on Rustic land was perfectly legal, several times we asked him if it was ok to go ahead with the purchase. Once we had paid his bill and tax we asked for the deeds (escritura) however he said that there was a problem, the land the villa was built on was still in the builders name and the plot had to be segregated, this was not mentioned before, when we got architects involved they said that it was not possible to segregate the land as it was Rustic land.

We sacked the solicitor and tried to sort it ourselves but found it difficult as we don't speak Spanish so employed an interpreter who accompanied us to several meetings with architects. Out of frustration we employed another solicitor recommended by the interpreter who at first seemed to know what we were up against and now eventually we have got the land segregation and registered at the Cadastro in Almeria .

Now we want to sell the villa, it turns out the villa was never given a habitation license, the paperwork we had turned out to be mainly false.

Absolute mine field, cost so far in fees 10,000€ still not finished.

Lost all faith in Spanish solicitors, my advice to anyone thinking of buying a property in Spain is simply DONT.

Sorry to be so negative but it has been for us and still is a very traumatic experience, you put your trust and money in professional advice and just get screwed.

Do I lose my English Tax Residence Status if I apply for Spanish Residencia?  Before everyone rushes to get Spanish Residencia, they need to consider the disadvantages as well as any perceived benefits.

I intend keeping my main home in England and not breaching the 183-day rule. I found this helpful article (link below)

https://www.spanishsolutions.net/blog/newsletters/residency-for-british-citizens-in-spain-and-the-3-6-month-confusion/

but I'm not sure if I unfortunately die in Spain and am cremated there, whether I need to ensure my ashes are returned to England. so that my English AND Spanish properties (residences) are not deemed to be under the Spanish Inheritance system. Has anyone  any experience? I culd only find this:

Looking for country property for long term rent - 10 replies

MB001 Posted by MB001 in General Almería discussion on Tue Feb 26, 2019 6:10pm

Hi all, we are a couple looking for a long term rental, preferably unfurnished with pool. 3 bedrooms/2 bathrooms. Rent ideally up to a maximum of 700€ a month. Himself is just coming up to retirement age, but in good nick, so is able to do a bit outside. I'm a few years younger, so can help! :-)

We have found many properties up for sale but without habitation certificates,  which makes them a bit more difficult to sell, so may be owners of those properties might consider renting. We are happy to undertake our own maintenance, repairs, etc. and literally treat it as our own.

Currently living and renting in Costa Blanca, but looking to relocate to our first love of Almeria.

Please message me directly for any further information.

taxi - 0 replies

kathy2017 Posted by kathy2017 in Buses, trains and public transport in Almería on Mon Feb 25, 2019 7:17pm

Hi

Are taxis available to go to La Oficina De extranjeros in Almeria.  If so, is it best to get one from outside the bus station and what is the usual fare?

Thanks

Kathy
