Can anyone advise is it true that if we are applying for Residency do we have to be living in Spain for 3 months prior ?

No, you don’t. You need to be registered on the Padrón and your Certificado de Empadronimiento must be less than 3 months old. You also need to be able to prove income and health cover
The confusion is possibly because you need Residencia if you wish to stay in Spain more than 3 months.
Please also note that once you have Residencia, for the first 5 years you may not spend more than 6 months in any one year outside Spain, and you may not spend more than a total of one year in a five year period outside Spain; doing so puts your Residencia at risk.

Dario -We will do 6 months in Spain and 6 months in UK and pay our taxes in UK because we are working in UK.

I have just read on The Local Esp website that you must have been living in Spain for 3 months before you can apply for residency -another misleading piece of advice.

Well ... as long as you don’t spend more than 1 year in total in a 5 year period outside Spain. That may invalidate your Residencia. Pre-Brexit, this was always something that was not paid much heed .... now? I’d guess Spanish authorities will start tightening up and with the introduction of ETIAS in 2021, there will be electronic records of exactly how long you spend in the country.

surely if you have residencia in Spain you pay your tax in Spain? even if you work in the UK.

Not necessarily - residency and tax residency are two different things. Residencia gives you the ability to spend more than 90 days in 180 day period in Spain.
Tax residency is when you advise HMRC that you are resident in Spain for tax purposes and cease paying UK tax

As somebody who plans to move from France to Spain this year - Is it like France was until recently that you fill in a tax declaration annually and pay your tax a year in arrears ?
