Having just bought here in July, you need a good Lawyer to make the required Search's and get a Survey done. Our buying went through without any problems at all. If you would like any details do get in touch. Cal and Dee

Well it would go through if the property met all the criteria.

Town Halls in the past have been in many cases the biggest culprits of allowing and licensing building on illegal land.
Often misdescribed as legal or illegal builds.
A simple search on the internet will provide enough information of the number of " Lord Mayors' doing time for corruption- in English for taking backhanders and allowing building on land that would never ever get sanctioned from Central Goverment.
Vera is a big culprit. We all saw on tv the home being bulldozed flat, yet the garage stayed because according to Central Gov was situated on legal land.
When you look at village property you are more at risk than a large modern urbanization.
A ' habitation licence' is no guarantee that your property is on legal or illegal land. It could have been issued by the same " corrupt council".
How do you check?
The only way to be sure is show a Spanish Abogado your intended purchase.
Most Abogados will tell you instantly whether its an area to avoid.
Other than that the Abogado will do the type of searches only a professional can do and then take responsibility for it
You need to be very careful.
I have friends who fell into the same trap, thinking they had a legal property because they had habitation licences issued by the council.
Now they are like thousands of innocent but misguided expats that live in fear of losing their homes because they found out their homes are built on illegal land.
Good luck.
That is so scary. Its hard to believe that it can still happen.I think it is putting me off the idea of off plan. But thank you for all the information it is appreciated.
