Hello, we have been here a few months looking for a house and time has caught up with us so we are going back to england for a visit. We have found a property which is being renovated by builders at the moment, we have ben told to obtain residencia and would like to get all that sorted when we come back, but we don't know how long we have to stay away before we can legally come back. Any knowledge or information would be greatly appreciated and thankyou in advance.

When you are more than 183 days non consequtive in spain you must apply for residencia.

look, until next March legally you can be in Spain all you like. after that, we'll see.

yes, it may be a legal requirement to apply for residencia if you spend more than the allowed number of days here, but they are hardly going to deport you or bar your entry if you don't have it. you may, however, get a knock on the door from the Guardia at some point if you haven't started the process when you should have, although more likely they will chase you if you haven't sorted out the matriculation for any UK car you may have driven over.

residencia is a requirement for tax purposes and also to claim any benefits down the road. if you are buying property you are on the hook for Spanish taxes in any case so you may as well apply for residencia.

No, when you are here you need residency before you complete 90 consecutive days. Check on Spanish CAB site.

Tax residence, not residency.

Residency has to be sought within 90 days. All EU/EEA and Swiss citizens do need to register with the authorities within that time and get a national identity number. You are resident in Spain for tax purposes if you spend more than 183 days in Spain in one calendar year. This is whether or not you take out a formal residence permit.
