Depends on if land is Urban or rustic. Rustic is above ground only. But lots of people have in ground pools in rustic land. If Town Hall find out they could make it be filled in or more likely you'll get a fine.
I did read somewhere that the Spanish Government were going to do a drone survey so the could raise lots of revenue fining people who have an in ground pool.
Pretty ridiculous really, but they have some strange old laws in Spain.
Peripherally on the subject:- Maintaining, cleaning a swimming pool ain’t cheap. We all love pools, of that there is no doubt. Tale a trip around and notice how many pools are idle or filled in. Most of my friends who have private pools regret the day they bought property because of the exponential expense.

'Pretty ridiculous really, but they have some strange old laws in Spain.' you conclude.
In England and Scotland (and probably Wales) a building warrant is required to ensure the pool complies with Section 6 (energy) 2015 of the Building regulations, and in many cases Planning Permision is also required to build a pool.
So we have some similar 'strange old laws' in Britain too, even though we would lose a lot less water than in Spain as the pool evaporates in the blazing sun... I think we might resent foreigners encouraging other foreigners to break the law too.

OOOOOOOO, somebodies tired.
I agree the planning laws in UK are ridiculous to the point of being stupid. But Spain, IMHO, does like a bit of red tape. I've just paid Arboleas Town Hall 400 euro for a permit to rebuild a collapsed wall and increase the height of some others. Now they wouldn't do that in the UK.
But the OP asked a question, I answered from my opinion/experience. I wouldn't encourage anyone to break the law, but I really can't see the difference between an above ground pool and a in ground pool on your own private property. I'm going to be paying a Spanish contractor to do job, so it's all money into the local economy. What's the problem?
Have a good one.

On the topic. When we had our in ground pool built I asked our builder (Spanish) to make it the same depth all the way through. It meant that all the pool was useable and it was warmer for longer
As far as one of the previous posters mentioning a drone. Yes we had that, not only did our IBI increase but we had to pay for the privilege of being photographed 🤔🤔. Still you know what they say about death and taxes!

I asked a builder why one has to pay for a permit to remove an indoor wall, affecting no one but inhabitants of the house. He said that it was to ensure that the rubble was disposed of legally . I do remember, many many years ago, elegant new hotels in Spain next to scruffy heaps of rubble - and my mother in law admiring a brightly coloured streak of 'flowers' on the mountainside which at closer sight was dumped rubbish... Things are much tidier now, and roads smoother, but I do miss the donkeys.

I miss the pool I had built (legally) after I moved. I cleaned it myself and was pleasantly surprised how little it cost to run....

We miss ours too. Didn't find it too arduous watching hubby clean ours. 🤣🤣🤣
