With all due respect, i suggest you read the comment i was answering before you start bring immigrants into it. DebraH said she was coming for 4-5 months, therefore i suggested she didn't get hung up over it as she is here under 6 months. Therefore no no nation rules are been broken. The passport takes care of it

Over 3 months, Residencia is required - I can post link to national requirement if you like?

The “more than 6 months” belief is a fallacy.  Your passport is good to live and work here for 3 months only.  After that .... Residencia

Ok, in that case i stand corrected. That said i would not consider someone visiting as a tourist for 5 months an illegal immigrant

My husband and I are also coming out for the winter months.  Over travel insurance covers 1 trip for up to 180 days.  I am thinking that coupled with our EIC card will cover us  - fingers crossed.

EHIC only really valid - or useable - for stays of up to 90 days. EHIC is for when you holiday in a country.  More than 90 days and you are deemed to be residing, rather than holidaying.  I would be cautious if relying on your EHIC for longer than 90 days......

Have EIC card plus travel insurance for a trip lasting up to 180 days. - so think We will be covered, but will go to town hall when we arrive just to be on safe side.

Just a suggestion.  How about taking a weekend break by the wonderful beaches of Tamuda bay in Morocco, 3/4 hour by ferry via Ceuta?  Some lovely hotels amazing  value out of the summer season, and Morrocco stamps passports (no visa needed for Brits) if you want to prove you have not been continuously resident in Spain? Works for India with similar residency rules!
