I am no expert but my mum just went through this recently using the services of a local woman to help with the process.  I'm fairly certain that with regards "proof of income" as is being stated on here, if you are in receipt of a state pension then I think that is all you actually have to p...

...rove - my mum just used her latest letter confirming what her state pension was.  Then again, that is possibly because the max state pension is more than the €5538 that chrisso50 has stated.

Thank you,  You have been very helpful.

Tracey.

I was in exactly the same position as Kathy - Irish passport, and U.K. state and occupational pension - and recently got my residencia in Almeria.  But I have to say that extranjería had great difficulties with the concept of being Irish and British at the same time!  Part of the problem was that when I got my NIE in 2004 to buy a holiday home here, I only had a U.K. passport and so that nationality is recorded on my NIE.  In the end, this was causing so much confusion - even leading to a refusal on the basis that my S1 proof of health care didn’t count - that I started the whole application process again, this time with success a week ago.  Right at the very end of my successful application when the administrator printed out a document for me to sign so I could collect my certificate, I realised she had still got me down as a U.K. citizen.  This was changed but shows the problem.

My advice would be that you need to complete the application form listing your Irish passport number from the beginning - my first failed application gave my NIE number as I know that off by heart.  Of course, if you do not yet have a BIE, there may be less of a problem but I would not like to bank on it.  Another point to watch is on proof of income.  I had never needed the residencia in the past as I never stayed over the 90 days.  But Covid meant I could not get the ferry back with my dog in April. As proof of assets therefore I tried to use an officially translated print-out from HMRC of my tax return, but Spanish authorities like to see everything signed and stamped.  All letters I had on my occupational pension had been sent by email. Despite the regulations stating that a conveyance can be used, the officials were adamant this was not satisfactory.  They also indicated they would not be happy with statements from U.K. banks. In the end I transferred 6000€ into my Spanish bank account and got the bank to issue a signed stamped certificate of the amount in my account!

From what I can gather, the local extranjería in Almeria has been thrown into confusion with it all, particularly since the introduction of the new TIEfor U.K. citizens.  Consequently documents they may have accepted in the past, were NIE treated with suspicion.  At one point they even tried to argue that I needed to get the S1 healthcare certificate translated, despite it being abundantly clear in law that as an official EU document it does not need translating. Good luck!

Em - thanks so much for this - what a trial you have had! But we can all learn from this...

Thank you for your reply.  I just saw it this morning and will have to read through it again.

I started renting long-term in Roquetas just over one year ago.  Before I began renting I just had my UK passport, so everything was signed up with those details.  However, the rental agency advised me that I would be better off with a Spanish bank account for payment of bills etc., I went and got myself an NIE as most of the banks that I went into whilst in Spain wanted an NIE as well as passport details.  When I applied for my NIE I used my Irish passport which I had just received, so my NIE was issued with details from my Irish passport.  I took my new details to the rental agency and the lady there recorded the change, however, when I get the invoice for my rent the details of the UK passport are still on it, but the invoices for my electricity and water charges have my Irish passport details on them - so a bit mixed up.

I have not been able to get to Spain or to my apartment March, May or August as my flights with Jet2 and Easyjet were all cancelled. I travel from Northern Ireland and when travelling with Easyjet Iwould travel through Gatwick. I had planned on applying for residency but at present that doesn't seem possible as I'm not in Spain.  I am still paying all charges for my lovely apartment as I don't want to give it up.

The health provision would be most important for me as I must have cardiac monitoring and procedures carried out for the rest of my life.

I can only live in hope - so to speak and see how things pan out.

Again thank you for your detailed reply which I am going to read through again.  I am very disappointed as I was organising myself to go to Spain, see a solicitor regarding applying for residency and like most people never thought that recent events would have ever happened.

Regards

Kathleen
