We are a British couple living in Belgium for 34 years and wish to retire to Spain. We hold a EU perminant residence ID card "M" giving us the same rights as a EU citizens as per Brexit agreement. Since we have the right to live and work within EU does this alow us to purchase a property and live in Spain with little or no problems other than registering with local community administration.

I stand to correction but your card gives you residence and work rights in Belgium only if you hold a UK passport, it does not grant Freedom of Movement.

It WILL however make it easier to move to Spain - I believe you would be able to settle in Spain using the same residencia system that other EU Citizens enjoy - again here I stand to correction

Thanks, it seems that since we hold the EU "M" ID card post Brexit giving us the same status as a EU citizen with regard to freedom of movement within the EU it shouldn't be too difficult for us to claim EU permanent residence in Spain. We will see it workd next year.

As Dario says, your WA rights in Belgium as a British citizen do not give you freedom of movement. You may visit another EU country like Spain freely - and apply for residence status there - but you would not have the right to work outside of Belgium. But retiring here should not be a problem as long as the income requirements can be satisfied.

Thanks for your comments but I believe the EU ID Belgium "M" (Post Brexit)  ID is an EU right of free movement for permanent residents live and work the same as a EU citizen since we have EU "permanent resident) status. I will have to contact the relevant Embassy to clarify the position. Thanks for reply.

No.  No British passport holder post Brexit has Freedom of Movement.

I had a look at the classification - the Belgian M card is much the same as the Spanish TIE allowing work and residence in country of issue; there is no card, visa or arrangement within the EU that confers the right of Freedom of Movement upon a Non-EU citizen.

The M card was required post-Brexit to allow UK citizens to remain in Belgium, in much the same way as a TIE issued under S18.4 of the WA conferred residency rights to UK citizens resident in Spain pre-Brexit - but like the M card it confers residency and work only - it does not and cannot confer Freedom of Movement.  It is the passport that matters, not the class of card given for residency

Thanks for the further clarification Dario. It’s because of Brexit that we are no longer ‘EU citizens’ - because we have lost the FoM we once had. And so have our children and grandchildren still living in the UK. Of course that strong & stable Mrs May said we were ‘citizens of nowhere’ anyway. And at least we remain immigrants of a specific EU country, if not citizen nationals.
