Hi,

Myself (Lynn) and partner Paul are coming to stay for 6-8 months,( just taking some time out) we are just in our 60's and would like to know if we are required to apply for residency, we are not going to be working.

If you are going to be here for more than 90 days in a year then you will need to register on the Padron at the Town Hall then apply for Residency. Amongst other things you'll need to show evidence you are covered for health care here.

Is it 90 days per year or a stay in excess of 90 days. We visit for 2 visits of 80 days and dont register but we do hold NIE numbers and own a property.

As I understand it, it is the total number of days you spend in Spain in a year between 1 Jan and 31 Dec that is important, not individual stays. But getting professional advice is very important. Of course many people just choose to ignore the requirements, not least because passports are often not scanned on arrival and departure so they don't really know how long you have been here. They are getting hotter about people "slipping under the radar" but I know of several people who have been here for a year or more and still not started the Residency process. That's not a recommendation to ignore the rules but you need to weigh up whether it will really be worth it. As from next year we will spend more than 90 days in Spain each year (but probably no more than 3-4 weeks at a time) so will be starting the process for Residency in October with the assistance of our lawyer.

Having just come back from Oficina de Extranjeria in Almería today, assisting someone else, I can confirm what Rob says.  More than 90 days cumulative in Spain and you must apply for Residencia.  As mentioned, you can possibly slip under the radar, but with Brexit looming, I imagine they will start tightening up.

Myself hubby and our little Shih Tzu will be moving on the 1st of September. We are going to be putting everything apart from some clothing and personal items into storage. We're going to be getting the ferry early on the 1st and are still to set our exact routes through France and Spain but hope to be there on or for the 3rd. We're presently looking for a rental furnished home for the next 6 months. Do the agents ever do as they say they will. So far its been hell, we've friends out in vera playa who are well known local businessmen. who for whom my hubby will be working, its a year round position and he's really looking forward to it. These friends have offered to view anything we find online. Im disabled with mobility problems and some of my health problems is osteoarthritis so hopefully, my symptoms will improve greatly out there, It's very important i get out and find locals who I can participate in things with, as not working in a new country on my own all day  could leave me very isolated with hubby working long days.

I am apprehensive but very excited looking forward to our new lives next spring we are hoping we will find a semi-rural villa, Finca with a pool to rent or rent to buy unfurnished.   

Any ideas or infoirmation will be greatly appreciated.

Try Adele at Voss Homes, slightly inland from Vera, but a more tranquil lifestyle.

PS no info on UK website enforces 90 day rule, if anything it covers UK resident visiting for holiday as excempt, under freedom of movement for EU citizens.

I take it you don’t mean the UK Gov link I posted?  That one very clearly spells out the requirement for residencia if more than 90 days .....

Yes, the wording refers to "recide", if you maintain a home in UK, and only visit, this is not recidency in Spain, you are recident in UK.

Ah.  There’s where the confusion arises.  “Residencia” in Spain as per above link refers to residency for tax-purposes.  Even if you maintain a house in the UK, you are required to register for “residencia” if you spend more than 90 days in Spain, i.e. you are a resident for tax purposes.

No pasa nada - I am led to believe that post March 2019, things will tighten up somewhat.
