I think you'll find that it is a Castor Oil plant.

Looks like a type of thistle to me.  A weed anyway.

Hi, I had what looks like the same plant appear. The spiky pods contain seeds. I have uploaded a photograph of what it looks like when the plant flowers. However the flowers only open at night and close when the sun touches them.

Hi. I also have a few of these in the garden and always, because of the spiky seed pods, assumed them to be castor oil plants. On checking again, mine also have white flowers and therefore I now believe them to be Datura plants. Sorry for the misleading post earlier.

Looking at  your plant   the leaves are nothing like the ones on my plant. mine are almost like holly leaves

There are numerous varieties of Datura which vary in size, colour and leaf variations. There is certainly a variety with holly like leaves as well as the ones shown in Diane's pic. If you Google 'Datura leaf glossary' you can pin down exactly which variety you have.
