Hi, can anyone advise me how to get health insurance after Brexit . I am 76 and my wife is 74, the sort of figures we are being quoted is over £15000 a year and we want to be in Spain between October and April. We do not want residency at our age , so any suggestions please.

Ps this is a British insurance company quote and we are healthy with no real health issues.

if you are saying you will be in Spain for the period of time quoted you will exceed the 90 days in 180 and that would make any health insurance invalid you could look into annual travel insurance cover instead.  not going to be cheap thought.

As u will in Spain for more than 90 days you will legally have to apply for residency.

Unsure what your age has to do with it.

The law is the law whatever age u are.

Er, sorry. Wrong.  90 days in 180 applies to Schengen Zone and has done since around 2012 if I recall.  Brexit has nothing to do with it.

To stay in Spain October to April you WOULD need Residencia, as you would be going over the 90 days allowed now.  As I said, this is an EU regulation applying to whole of Schengen Zone.  It is a popular misconception that pre-Brexit you can spend up to 6 months in Spain.

So if you are holidaying for 90 days, you will require travel insurance; if you take Residencia you would require private health insurance.


Visas and residency

You must register as a Spanish resident if you want to stay in Spain for more than 3 months.

You will get a green A4 certificate or credit card-sized piece of paper from Extranjeria or the police.

Last time I tried to go to the local police station to let the, know that I had been in Spain for 90 days they just laughed and said ok , didn’t ask for my details ( I don’t think they even knew what I was talking about.

If a member by the tag of Truenudist sees this thread, you can ask him what happens when you overstay 90 days.

Why on earth would you go to Policia Local to tell them you had been here 90 days?

The Policia Local will not be the slightest bit  interested in your reaching 90 days .... it’s when you come to exit the country having overstayed that Cuerpo Nacional de Policia become interested.  More so now with Brexit approaching.  It’s been something that has only had lip service paid to it in the past, but with the introduction now of the new TIE system as from July 6th, I can guarantee Spanish authorities will be paying closer attention.  The introduction of ETIAS in 2023 will be the final nail in the coffin of overstayers.

Overstaying risks a fine - a large fine - or even possibly being barred from re-entering the country for a period of time.  As I remind everyone to whom I tell this, your 90 days starts the moment you enter the Schengen zone, so if you drive through France, the moment you touch French soil is when the clock starts running.

Like I said, it is a popular misconception that you can spend 6 months in Spain without Residencia - very very popular - but still a misconception.

One thing here Pam5rick and this is very simple. You are totally wrong!

You cannot stay in the Schengen area for more than 90 days without registering. 

Dario, Alicia, Carwyn are all very correct.

In another post on this site I have briefly explained what happened to me for overstaying the 90 days. It was not pleasant, and I can tell you at 76 and 74 you do NOT want to be in custody and questioned by police, with guns, in a foreign country whether you speak fluent Spanish or not.

I suspect the reason you are being quoted exorbitant rates for health insurance is because the companies are aware that if you are daft enough to stay over the 90 days you'll be daft enough to pay the £15,000!

Its quite simple.

Your choice is either Residencia and get a S1 certificate from the NHS that will give you reciprocal healthcare here in Spain,

OR, you get normal Travel insurance to cover you for the 90 days you are here. ( and here's a tip make it 88 days ).

Your planned stay from October to April is fantasy ( legally ).

I know what the confusion is here and many, like you, think the same way. 

You believe that because you can stay 90 days in 180 days you think well I can stay for 180 days in any year. In other words two periods of 90 days back to back. If you stay in the Schengen area for 90 days you must then leave the Schengen area for a similar amount of time. If that was not the case they would not say 90 days in 180 would they. As Dario says, its been like this for a very long time now. 

So its just a matter of understanding the law. I've spoken to many people on the ferry with their motorhomes setting off at the onset of winter in the UK and then returning for the summer 6 months later totally oblivious and ignorant of the law. And its easy. Your passport isn't date stamped when you leave UK or when you return. If you fly in there is a chance you will get your passport date stamped ( I did ). 

The potential fines are horrendous. 

Sorry I've gone on about this but please just don't risk it.
