Threshing circles ??

Hello All and Happy New Year,

                                                       Just a bit of advice if you guys can please, we found a villa we really like and reserved it in November but after going through land searches etc it appears that the current owner of the house has assumed the rights of an ancient threshing cirlce at the side of the house but indicated it belonged to the house? After our solicictor made enquiries it appears it belongs to the Town Hall but as its not been used for its original purpose for possibly 100 years or more the current owner has claimed it, gravelled it and assumed its use.

Its a large area along with the rest of the land its about 2 acres, we have said we will pull out but the agent and the owner say this is quite normal in Spain? I dont seem to be able to get a defined answer from anyone so i thought id post to see if anyone has had the same thing?

We dont really want to pull out but can anyone put my mind at rest?

Hi you are correct to be cautious. If it belongs to the Ayuntamiento then it's possible the owner is a family relative of the Mayor. If you fall out of favour with the Mayor after a purchase God only knows what will happen.

What about asking, through your solicitor ( who should not be suggested by the estate agent ) to approach the Ayuntamiento about purchasing the land with the villa???

Other than that I would tread very carefull. Btw DO NOT LISTEN TO YOUR ESTATE AGENT SAYING DONT WORRY ITS NORMAL IN SPAIN.

Lots of people have lost their life savings because of that sort of talk.

Hi, 

Jack is absolutely correct although when on rural land & sited between properties it is Communal. There was a case in Baza not so long ago where the Threshing Circle had been claimed by the new Brit owner, a wall and Swimming Pool constructed. Everything needed to be demolished further to Council action.

I can even give you the name of the Estate Agent if you pm me although believe that woman has now moved to Granada.

Again, never use the Solicitor suggested by the Estate Agent but if you want a 100% professional then Amanda Oakley of ALO LEGAL SERVICES, Zurgena.

We are rural and have a Threshing Circle.

                                i intend now to get in touch with Amanda Oakley after speaking with the estate agent again on Monday, just read back on my emails and it basically says about the circle, "its communial belongs to everyone but no one" and then finally that it belongs to the townhall??

Im going to see if Amanda can dig up any info.

Didn't need to. It's on boundary of property so at one time was communal. Sandra & I restored as a feature.

At one time.one chap tried to claim it was.his which was when.we enquired. He has since died anyway.
