But I’ve found that coming into Gibraltar from Spain the Passport control is Gibraltar manned , going the other way back into Spain is Spanish controlled, interesting just have to wait until January 21 to find out.

Yes - but after January 1st though there will have to be checks going out of Spain as well as Gib will no longer be in the EU.

Unless, of course, it returns to Spain ......

“Whats to stop you” overstaying your visa? The simple answer of course is that nothing will stop you doing it if you want to do it. However, you will, after the expiry of your visa (or your agreed visa exemption period), become an illegal immigrant, ie you will be in the Schengen area without a valid visa or visa exemption. Its not a case of overstaying your visa. That of course is illegal. More a case of a possible loop hole in the law, which by all accounts does not exist.

Loopholes are lovely things, however I was replying to the original question, which clearly asked about overstaying in the Schengen area......

Dario, what do you think will happen as regards all the Gibraltans who own property in Spain?  Some of them are virtually living in Sotogrande, which is understandable really to anyone who has ever been to Gib.  There are loads of Spanish people who cross over daily to work in Gibraltar too.  Crossing the Gib/Spanish border is going to get very complicated.  I can only imagine the queues!

I think Gib residents / workers will get a permit or visa which will allow hassle free crossing of the border.  Those of us without permits will suffer looooooooooooooong queues
