Opening a business in Spain

Morning all, my husband 21 year old daughter and myself own a house in Albox and we were thinking of moving to Spain to open a business.  However, I have been informed that as we are all British citizens we are not allowed to do so.  Does anyone know if that is correct?

you may own a property here but unless you are residents you will have to satisfy all the new rules on income and health care to come here and become residents first. As for opening a business that is another expense that you would have to research fully before committing to it and it is a red tape minefield depending what you want to do.  So lots of research anyway and good luck.

That is correct. As you are now Third Country Nationals, you may not work in Spain without first obtaining a work permit.

For self-employed / open own business, to get a work permit, over and above the financial and health requirements for Non Lucrative Visa (does not allow work), you will need to show sufficient startup capital to get the business up and running, you will need a comprehensive business plan indicating your research into area if chosen business and figures to support expected growth, it’s benefit to Spanish economy AND ... (I’m not 100% sure but ...) you may need to demonstrate an ability and intention to hire Spanish staff.  If that IS a requirement then that puts starting a business out of reach for most (unless you are a multi-millionaire) because retaining Spanish staff means giving them a contract and payment of their Autónomo as well as your own.... 

if you REALLY want a business, it’ll be cheaper to come over on a Non Lucrative Visa, do your 5 years to become permanent resident, THEN after that 5 years start a business as the “no work” restriction falls away on permanent residency being obtained

Hi,if you are residents then there is no problem, but,, I would ask a Gestoria rather than asking just advice from people who are not fully informed.

I've traded in Spain, self employed and also had a Spainish ltd company ,all easy, so a good Gestoria is best for advice.

Yes, good advice  is free, but they will have the info. And forms for you to fill in and get it all processed properly.
