Hi, moving to Spain next year. What are the financial requirements for us if we do the civil partnership and my partner applies for spouse visa? I have an EU passport and my partner has a British passport. Thank you.

COST: you each have to make a once-off demonstration of availability of IPREM i.e. 7.200€.  This can be done with letter from a bank certifying that over the previous 12 months your balance was above that.

ALSO: be advised It will depend very much what area you move to as to whether civil partnership is accepted; some Extranjerías won’t recognize Civil Partnership or De-Facto partnership for Dependent or spouse of EU Citizen applications.

Malaga does - I know someone who got just such an application through, Almeria often do not - again, same person was unable to get application through Almeria, had to go to Malaga.  Each office appears to interpret the rules differently.

Thank you so much. Regarding the civil partnership, if not recognised in Almeria, would that mean we wouldn't be able to live there?

Once you have the Residencia, you can live anywhere - bear in mind that Almeria also is having problems at the moment in even giving appointments; there was a demonstration on Friday if I recall by Union / Association of Solicitors as Almeria has not been providing any appointments for TIE etc.

However. Don’t take my word for it, Almeria could well now have had a change of staff and so are interpreting the rules in your favour.  Your best idea will be to contact a Gestor or Abogado (who is experienced in migration) and ask them.

Someone like Mundi Abogados at Vera Playa speak frequently with Extranjería in Almeria and are right up to date with all requirements - they’ll be able to give you a definitive answer.
