Hi everyone

Now we are leaving the EU does anybody know if we apply for residency in the next few months ( in the transjtional period) will it still be valid for 5 years or has this changed.

I appreciate your advice

Hi,

We are all waiting expectantly for the Spanish Government.to make a final & substantive decision, hopefully after the 31/1/2020.

You may be absolutely correct but the last year has seen so much change & guess there's more to come.

Anyway, I would consult CAB in Spain or a Solicitor especially if you have one earmarked.

Yes, basically. As long as you apply for residency and obtain it before 31 December 2020 you will be safely resident in Spain. After five years your residency automatically becomes permanent. 

But don’t leave it till 2021. New rules will apply from then as U.K. citizens will be deemed to be members of a non-EU country (post Transition) and the annual income requirements that have to be fulfilled to obtain residency here in Spain 🇪🇸 will be far more onerous than they are now.

Hi....We have just visited our solicitor as we have just bought a property here in Spain which we will be living in for 7 months a year minimum. She has advised us to wait until the middle of February to apply for residencia,  when as she says....'things should be a little clearer'....as if we did it now you might have to do it all over again then!

Our solicitor is María Maroto Pérez, and she is in the shopping parade near the large roundabout at vera playa....

Why would you have to do it “all over again”?  That is quite .... surprising ... advice.  Spain’s position has been laid down in a Royal Decree issued nearly a year ago now.  There has been no change in that position as a check on the La Moncloa website confirms.

It was Pedro Sanchez who bought that law into effect aaaaaaand he’s back as Presidente del Gobierno so .... what exactly are they expecting to change?

The only change would occur if UK left without a Withdrawal Agreement and whilst House of Lords have amended it, BoJo has sufficient numbers to reject that amendment and ram it through anyway, so very little chance now of No deal Brexit..... which means the decree as promulgated for dealing with a Brexit with withdrawal agreement stays in effect.

It could be the same.....but if the House of Lords objects who knows.....You might even need a TEI by February! Watch this space!

House of Lords will back down.  They won’t push to No Deal.  You will not need a TIE come February
