In a nutshell, employment in various UK Government agencies (see link) comes under the double taxation rules. Your Army pension would be taxed in the UK ( if it were over the threshold so to speak ). In my case I have two UK Government Pensions. I will pay the tax on them in the UK..........

( My UK State pension is another pension, some years off until that one is due......lol )

........that is when I retire to Spain, the tax on the two pensions is payable in the UK only........

Not sure how it all works out but we started paying our taxes  in Spain a couple of years ago i was taxed in the uk and taxed in Spain on the same pensions and then my accountant claimed the taxes back, that I had paid in the uk, the taxman paid it back into my uk bank account

Hi john99.  Just as a matter of interest did you receive a tax code notification this year?  We haven't.  I have written to them but the post is so bad at present i dont even know whether they have received my letter.   And i cannot get through on the phone.  Most frustrating.

Well we have just left it all up to our accountant in Mojacar (Carman ) she said if any problems she will contact us.

Yeah it’s often the case. A person should only pay one tax per se. If you end up paying UK and Spain you claim back like you have done....

Wol habe dann erfahren das mein Konto vom Finanzamt gesperrt worden ist und ich meine Rente nicht abholen konnte. Muss nun zum Finazamt und die Angelegenheit klären was noch nicht beendet ist. Habe keinen Brief oder Anfrage erhalten, wahrscheinlich weil sie wissen das ihre Post nicht arbeitet und die Briefe nicht ankommen, so kann ein Rechtsstaat nicht funktionieren.

For those who receive any UK public service pension taxable only in UK it is vital that the Spanish annual tax return has that income inserted by your agent in the correct box. Article 18 .1 of the DTT. 2013 has the heading Government Pensions. The Spanish version on the AEAT Tributaria web site has a quite different heading and meaning of the script which denotes the income to be inserted in the box headed CIVIL SERVICE . It is likely that if the UK income is inserted into that box, scrutiny of HMRC tax records will not find your public service pension provider . It may find an income, maybe a pension ,but really that box is for Spanish civil service pensions. Ask your agent about box 470 .....Renta Extentas Excepto para Determina el tipo de gravamen.  This could be good advice .....try it with your agent before inserting into that civil service box. Mine got flipped into world wide income taxable in Spain, in error every year from 2014 ..... now trying to correct it, and HMRC are also trying to sort out this widespread problem under Article 25 ...the resolution procedure. I have seen several posts on this tax issue ......please ensure your agent has the latest software which hopefully has the correct box on the database to include in modelo 100 for 2021.  The process starts for on line submissions on 7 April and ends on 30 June.
