 By complete chance the sale  of my holiday home in Vera Playa was completed on 28 October 2021. This was two days after Spain's highest Court issued a decision that the method of calculating PlusValia was illegal. A few days later a new legal method of calculating PlusValia was announced by the Government and took effect from the date of the announcement. Five months after the sale of my property was completed my Spanish solicitor is still retaining almost €4000 just in case PlusValia still has to be paid. I cannot see how there be any legal basis for me to have to pay PlusValia now when it was wasn't payable at the date the sale of my property was completed. Is there anyone on the Forum who is in the same position as me or knows someone who is? Regards, Roy

Hi Roy

I was in the same position but did not need to pay or have any monies retained. As far as I am aware during that short period the law courts deemed it illegal and councils could not until the law was changed therefore your solicitor has no right to withold your monies.

Mine was in Murcia however if you are still in Spain I would suggest you go to your local council and ask them there

We are wondering if anyone can offer advice on the following problem .We sold our villa in September 2019 and our solicitor duly applied for the repayment of the Plusvalia Tax . We have been told that it was passed by the town hall in September 2021 but we have still not received any money .When we contact the solicitor they say we will just have to be patient .We have learnt from your sight that the laws changed regarding this tax . If anyone can offer any help on how to get our money we would be very grateful Thank you
