Staying longer than 3 months

Hello, my wife and I are hoping to go to our apartment in Vera some time in October for up to 3 months. If we wish to stay over the 3 months,  can this be arranged whilst we are in Spain? Our decision will all depend on what is happening in the UK at the time. If it is possible how would we have to go about it?

Unless you possess an EU passport (e.g. Irish) the answer is a resounding “no”.

If you hold a UK passport, it is no longer possible to apply for Residencia and do 6 months here, 6 months overseas.  You have to apply to migrate, and that must be done from the consulate or embassy in your parent country; further to that, a condition of the visa will be that you do not spend more than 10 months aggregate in the first five years absent from Spain.

If you have an EU passport, then Residencia is still an option, but it must be borne in mind that Residencia is not an extended holiday permit - it means Spain becomes your country of primary residence.  You will be obliged to spend a minimum of 183 days a year here to fulfill one of the conditions of maintaining your Residencia, be tax resident and pay tax on worldwide income in Spain.

Absent either of those two options, you are not permitted to spend longer than 90 days here.

Oh well........but thanks for the detailed information. Another question that you may be able to advise on. When we book our ferry crossing do we have to declare a date for return before we set sail for Spain?

That … I cannot answer - I simply don’t know.  I would respectfully suggest a travel agent may likely have that information to hand.

There is the probability though that someone else on the forum has been through this and may be able to answer the question.

Hi. Unfortunately, unless you want to become legal residents of Spain you are limited to 90 days in any 180 day period. This is the rule for all non EU residents and no way around it.

i would think that it will be a requirement from border control that you have an exit date to show on entry so a return trip would be necessary to prove you intend to leave the country.

Thanks. We're booking a flexi ticket so we can change our return to suit should we wish, or need, to come back earlier.
