Padron

Padron’s are issued by The Town Hall. 

We finally got ourselves added to the Padron in Los Gallardos last week after 3 years as we will be spending more than 183 days in Spain from next year and will be going for residencia as well shortly. I don't know about the town hall in Turre but in LG I had to complete the forms in Spanish accompanied by escritura and passports. They didn't ask for NIE numbers. Not a word of English was spoken throughout the form-filling process but it was all very friendly and they were tolerant of my Spanish. It cost €1.50 to get the copies of the signed certificates 6 days later.

I have applied for Padrons in different areas in Spain over the last 10 years.

I have always printed my requirements in Spanish together with a list of documents I am producing. Never had a problem!

Well done Rob, that’s excellent, very glad to hear.  Just a quick word on your lengths of stay.

There’s two different amounts regarding lengths of stay which get a bit confusing:

The first is the 90 days in any 180 day rule - that requires Residencia (at the moment ...) it is a misnomer that you can stay for as long as you like on an EU passport.  You can live and work in Spain for up to 90 days on an EU passport.  Any more than 90 days in any one 180 day period requires, as I say, Residencia.

The second one is the one you’ve touched on - 183 days.  If you spend 183 days or more in Spain, you are obliged to be resident for TAX purposes.  This involves contacting HMRC and advising them that you are now “normally resident” (i.e. more than 183 days a year) in Spain.  You cease to pay tax as a UK resident and are now taxed as a Spanish resident and pay tax in Spain.

This last one is why some people either spend less than 6 months in Spain or pretend they do - they don’t want to be taxed in Spain, preferring the lower UK taxation rate.

Not correct - an EU citizen under EU law may stay 3 months without registration , if however they are "seeking" work they may stay 6 months without registration !

In addition the 90 days in 180 is a Schengen rule and does not apply ( yet ) to UK citizens who are still EU citizens , or to EU citizens at large. Schengen rules ONLY apply to non EU visitors .

Useful informative. My understanding is that as a UK visitor to Spain I can stay in one hit of 180 days max or numerous trips adding up to 180 days between Jan to Dec inclusive each year.
