NIE / Residecia Question

Can anyone clear up a little bit of confusion I have.
In 2007 I applied for our NIE Numbers/Cert. The move back then was called off due to the financial crash and family illness. We still have those NIE and already been told by banks and immobilier they are for life. We now are moving over later this year as I will be retired and my wife will retire next March. My question is, will I have to apply for " residencia " and what will we need further to obtain that ? ie what do you have to have apart from the NIE and Passport to show or prove. The different info on line is conflicting and confusing. Thanks

Hi  

I suppose.one route would.be to commission a Solicitor like Mr. Davies in Mojacar or Juan Rubio Granardos in Huercal Overa (ours ). They then usually  take you to process for the Residencia, which was in Almeria City in our day, 2003.

Now we have become aware of a www.which may be of some use in obtaining info.

This was actually mentioned on the Forum some time ago. Apparently you can web chat or phone chat with an English speaking advisor. Things constantly change here and over the years we have found a propensity for some lay people to obfuscate if they don't know.

You may of course hear from someone who has just been through the process so that would be more relevant. Have heard of people who have done the whole thing themselves.

NIE isus for life and currently so no needis the Residencia which, we were assured 14 years ago, was due to be discontinued. But just think of all those Civil Servants on the dole???

Thank you, I have had more or less the same response on the Mojacar forum but it's left me a little jumpy over the mention of tax on pensions.  :(

We pay our tax at source  into UK. We decided not to claim Gross pension in UK and have Spain then tax us. There seemed.to be a positive on the OA Pension but a negative on industrial / workplace pension.

Hi Kenny. 

There is Residencia and Residencia Fiscal. With the latter you will be liable for Spanish income tax which is substanially higher than Irish ( and probably UK ) tax. 

If you spend 183 days in Spain you are fiscally resident. But I believe that most expats are living under the radar and remain tax resident in their home country ( if any! ).

Like the OP I've been both told I dont need an NIE by one source unless buying cars and/or houses, both unlikely yet told by others that having an NIE is the best kind of ID to have especially tied to a (spanish) driving licenence as it obviates having to carry around ones passport etc.

We've also been advised we need to get a Spanish driving licence following 3 months residence for which we need...........you guessed it........Residencia !!

Who said retiring to Spain would be easy ? Lol

Your NIE is for life and is for all major and some minor purchases as the best form of ID.

As I may have commented, I was told I didnt need an NIE but as I am going to in the next few days will be getting Residencia. You need residencia for medical cards, prescriptions etc, from what my partner and I have found out when your retired here and have your proper medical card etc, you only pay 10% of the cost of a prescription.

You'll need to have proof of income from the International pensions office and the DWP, translated into Spanish.

We used Cam concepts in Huercal Overa and will be using them to do the residencia and the trip to Almeria to sort it.

We already have temporary medical cover for 3 months from the local town hall in Huercal Overa.

Its paperwork and legwork and good advice from a reputable abogados, lawyer, solicitor but worth it in the end.

Are you retiring here, buying or renting ? You dont say.

If buying then your solicitor as and when you engage one will help with all the paperwork, if renting you need proof and details from your landlord.

It's advisable to register on the local Padron, you'll need a form called S1 which you can get from the International Pensions team I think up in Newcastle which gives proof of income, you need in the region of €5500 which most UK State pensions more than cover as will your wife on a sliding scale, as will any dependant children you may have with you, not just visiting.

A solicitor should be able to fully advise better.

As above you can get 3 months temporary medical cover via the doctor you prefer and by visiting and registering with the local social services where you live, then you can apply for medical cards, you can have your passport minimised so you dont have to carry it around, legwork and paperwork and stamps, one visit to the foreigners office in Almeria, probably 3 months in total and then you can sit back and enjoy the slower pace of life lol.
