My husband and I will be making a permanent move to Spain in 2024. We are trying to get as much information as we possibly can. My husband has an Irish passport and a UK one, I’ve only got a UK one. We are legally married. I know he has freedom of movement and I can derive my right to reside in Spain through him. We have sufficient resources so that’s not an issue. Do we both need health insurance and is there anything we need to do before going out there? Is our first step getting on the padron, and if so how do we go about it? So many questions!! We just want to get this right from the word go. We will initially we renting and have already made enquiries into this. I’ve also found a few relocation firms but does anyone have any recommendations to get all our stuff over there? TIA. Sue.

To answer your questions:

  1. YES - you can come over as dependent of an EU citizen, so you won't need a visa
  2. YES - The Padrón - Once you have found a place to live and have signed contracts etc, you both need to register on the Padrón.  This will be done at the Ayuntamiento of the place you live (i.e. Turre, Vera, Mojácar, Gurrucha etc etc).  Generally Passports and signed Rental Contracts are all that is required, however Vera ayuntamiento sometimes wants Owners DNI, but the Estate Agent you go through should know exactly what the Ayuntamiento will require and will have it on file.  This has to be done first as you neither of you can apply for Residencia until you have a Padrón.
  3. YES - you will both require Health Insurance - either individually or on a joint policy that names you both explicitly.
  4. Your husband will apply for Residencia as an EU citizen, you will apply as the dependent / family member of an EU citizen.  He will get a Green Residencia card, you will get a plastic ID card (TIE) with your photograph identifying you as a family member of an EU citizen.

Thank you. We are maybe a bit too early to start the ball rolling yet but I will certainly keep you in mind. Thank you so much. It’s just nice to know we are on the right track.

Just make sure all your marriage documentation is clear and, if necessary, officially translated.  The authorities need to be 100% satisfied that you are married, otherwise it might just cause a problem.

Quite right and please note the apostille d and translated marriage certificate only has a three month life span after that you have to obtain another one.
