Hi, I'm presently in Spain looking for a property to buy and permently move to Spain.

I've just been informed about the Spanish "double tax" system. I'm hoping to get in touch with someone who has moved to Spain since Brexit. I have my NIE number and spoken to a layer regarding residency.Their fee of £1400 plus official fees seems very expensive.

Any advice would be greatly appreciated. I will be in Suan Juan De Los Terreros on 23rd January.

Clive.

Personally I think the fee you’ve quoted is high. Have you shopped around?

You use the term “ double tax” system. There’s a lot of confusion about this.
The UK-Spain treaty is designed to prevent individuals from paying tax twice on the same income. Individuals may have to pay tax in the UK and Spain if they are residents in the UK and have income or gains in Spain or if they are non-residents in the UK and have income or gains in the UK.

Your personal circumstances will dictate what you have to pay.

I would recommend Lex-Fix in Huercal Overa. Lawyers and tax accountant.

Email info @lex-fix.es or WhatsApp phone, 624 54 87 82. Speak to Dan Ogden.

Good luck.

Thanks for responding to my posting. From what you say, I shouldn't have to pay any taxes in Spain as I'm applying for a non lucrative visa. Or will I pay tax on my pension.?

I'm also keen to get in touch with any groups, especially English speaking, in San Juan De los Terreros, or surrounding area.

Many thanks

Clive.

As I said it depends on your circumstances, what type of pension, a Sipp, state pension, annuity, government pension, occupational etc..

All are taxed differently, as an example my wife has a civil service pension, that’s taxed in Uk. My Sipp is subject to cgt, not income tax. It’s a bit complicated to advise with limited information.

Take professional advice.

My only income is a fire service pension which is taxed in the UK.

I will call the  residency lawyer you have recommended and contact a tax consultant.

Hi. you do realise you have to go to the UK for your residency don’t you . Either Manchester , Edinburgh or London. Depending where you are from in UK. This is for your first year . You have to prove sufficient means to live . A pension and savings , adding up to 27k per year for the first year . Police checks in UK. Doctors note to say you have no contagious deseases.  Other have to be in Spanish , translated by an official, recognised translator. Apostiled too. It cost around £550 for the visa and another £250-300 for the police checks etc . The UK Spanish embassy then say if you can enter Spain. After 12 months , you reapply but this time in Almeria / Murcia, depending where you live . This is for another 2 years . Again you reapply ! For another 2 years ! 5 years in total . Blame the Brexit voters !!

A lot depends on which type of visa you are going to apply for. Some can be quite complicated

That’s for a NLV - non lucrative visa . I assumed when Clive said he was retired , he doesn’t want to work in Spain . All NLV applications are now started in the UK
