Hi 

We have been pondering the best approach for us to take with retiring to our home in Spain and would be happy for advice/comments

We own an apartment in San Juan de los Terreros that we love.. we plan to retire and live out our lives in Spain.  However we don’t believe we are ready to go for residency yet and we are trying to ascertain how much more difficult it would be after Brexit.

Is there any benefit of my partner perhaps moving to spAin before me and trying to get residency before the end of the year, would that be easier for me then to get residency after brexit?

We live quite a frugal life so don’t need a lot of money monthly, but I believe the annual income has to be over 27,000 which we would not have as we don’t plan to work once in Spain.  However We have good savings and will sell our UK house before we retire to Spain, but we don’t have great big pensions.

We have well paid jobs in the uk which we can’t afford to give up yet, 

We are 59 and 56

Any comments or advice?

If you don’t meet the criteria for third country residents then how will you get residency? On the information provided I don’t think you will be able to become residents, sorry.

Hi, best if you google it, and also look at the difference between the Withdrawal agreement, and how you are protected prior to Uk leaving 31/12/2020, compared to third country immigrants. There are thousands of articles.

I'm sorry if you didnt find the site useful. It seemed clear to me that after 2020 it was going to be considerably more difficult to get residency in Spain. I have always referred to that site and gained my residency etc through all the links they provided with no outside help. 

You say that you are not ready to give up your jobs in UK yet although you have funds available. It's a big choice and who knows whats going to happen in the next 5 years ( will there be an EU ( as we know it now ) ).

There will be reciprocal deals made between Spain and UK. 

My view is that if you are not both prepared to come to Spain before December 2020 and achieve residency your options will be unknown after that date.

Don't be disheartened. If you can't do it now many things might have changed and will change in the next 5 years and so there is no point in trying to plan or worry about future outcomes now.

As it stands right now, if you arrive in Spain after the end of the transition period, you are a third-country National, exactly the same as say an Australian or US citizen coming here.

The requirements are quite strenuous. Firstly, little known but mandatory, to obtain temporary residency you will be subject to a Spanish language test; you will be required to be conversational.  Secondly, income : you are required to prove an INCOME of 27.000 € per annum per person applying.  This is income; it is uncertain at this point if having money in the bank is acceptable, however possibly not.  This temporary residency must be renewed after TWO years at which point the income requirement rises slightly, then you must apply for permanent residency when 5 years have been completed.  In that time, you are allowed to spend an AGGREGATE of 6 months out of Spain over the 5 year period. Those are just the requirements I recall from Ministry of Interior website.

If you arrive and take up residency before 31/12/2020, you have until 30/6/2021 to actually apply for Residencia under WA regs.  Under terms of Residencia (as opposed to TIE) you need only show annual average balance of 9.050€ by means of certificate in Spanish from bank.  You are also able to then spend up to 182 days a year outside Spain.  As long as you spend 183 days a year here, you retain Residencia.

EDIT: the initial TIE is for one year, subsequent renewals are valid for two years, thus you’d have to renew twice before making application for permanent residency.  The income requirement though must cover the entire period.

I disagree. You must inform on the criteria to be met in Spain, before considering to move into Spanisch residency.
