Moving to Spain whilst working for UK based company.

Hello all, 

I am considering moving to Spain with my wife and young son 9 years old. I am British citizen,  my wife is Polish and my son has both nationalities.

I work from home for a UK based company,, and paying my taxes here.  I just need Internet to communicate with my clients and do my work. 

Am I able to live in Spain and continue working and paying my taxes in the UK? So many conflicting information on Google.

My wife and son are EU citizen,  shall I  assume they can move to Spain without any complications? 

Considering moving to Roquetas de Mar:.

Looking for your kind advice.

The simple answer is no.

If you live in Spain you are liable to pay tax in the country.

You should have no problem settling here and obtaining residence as your wife is an EU National. But as regards your work for a U.K. company a lot will depend on whether you are working freelance from Spain, whether you are a digital nomad, or whether you are under contract with your U.K. company. For sure you will need tax advice and should obtain this from an abogado here. Don’t rely on Internet advice from Bob in the bar!

PS: Roquetas would be a great choice!

If your wife is an EU national, you do not need to go down the route of Digital Nomad visa; once she has residencia, you can apply as family member of an EU citizen which immediately gives you the right to remunerated work.  It is quicker and less costly than applying for the DNV. 

Once you have been here 183 days though you become Tax Resident in Spain and whether you like it or not, liable for tax on worldwide income paid in Spain.  There is a double taxation agreement in effect between UK and Spain, so if you continue to pay tax in UK, you will only pay tax in Spain on the difference between the tax rate in the UK and the tax rate here.  If however you are resident here, it may not be possible to elect to pay tax in UK and you would most definitely need solid advice from a Tax advisor.
