Spanish government website on EU Exit

The Spanish Government has launched a new section on its website to help UK nationals in Spain prepare for EU Exit.

It covers topics including registration, healthcare and education, and confirms the Spanish Government’s intention to safeguard the interests of British nationals in the event of the UK leaving the EU without a deal.Further legislation via royal decree is expected in February.

"The United Kingdom has formed part of the European Union for more than 40 years. The goal of Spain and of the European Union is to ensure that its withdrawal takes place in an orderly fashion through the adoption of the Withdrawal Agreement, avoiding any impact of its withdrawal without an agreement. Whether an agreement is reached or not, the withdrawal of the United Kingdom will result in a change of scenario. Getting ready for this new situation is a necessary exercise. The question is to strive to address Brexit with the best tools at hand, something incumbent on all parties: the European Union institutions, the Member States, the United Kingdom and also on citizens and companies, informing them of the changes and adapting to them.

Within the site it states the following applies if no withdrawal agreement is signed off (i.e. No Deal) -

Without a Withdrawal Agreement 

I am a British citizen or family member of a British citizen resident in Spain before 30 March 2019. What will my situation be?

If the Withdrawal Agreement is not signed and ratified before 29 March 2019, the Government of Spain will provide a solution that in any event guarantee the legal security of British citizens and the members of their families resident in Spain before the exit date, taking into account the announcement made by the UK in this respect and the European Union guidelines.

What do I have to do?

Currently, the Government is establishing the precise terms of this process, which will be governed by the following principles:

  • British citizens who are resident in Spain before the UK's withdrawal date (29 March 2019) will be subject to the general immigration regime. In other words, British citizens who are now residents as EU citizens will be subject to the regime governing citizens of a third country.
  • All British residents in Spain will be considered legal residents in Spain. To obtain permanent residence [after 5 years of registered temporary residence] prior periods of residence in Spain will be taken into account in accordance with the regime governing EU citizens.
  • To facilitate documentation of all the British citizens in Spain, the registration certificates and cards of family members of EU citizens will continue to be valid until the issue of new documents under the general immigration regime (TIE cards).
What do I have to do now?

*** If you have not done so yet, you must register as a citizen of the EU and resident in Spain ***

Until the UK's withdrawal, you will continue to be a citizen of the European Union, and as such, if you want to reside for more than three months in Spain, you must register at the Central Registry of Foreigners, where a certificate of registration will be issued to you immediately, including your name, nationality and address, your foreigner's ID number, and the registration date.

This procedure will allow you to obtain a registration certificate that will be of great use following the date of the UK's withdrawal in either of the two scenarios.

In the case of an exit with an agreement, the certificate will allow you to prove your condition of beneficiary under the Withdrawal Agreement. In the case of an exit without agreement, this document will allow you to continue to reside in Spain and obtain the documents required by the immigration regime.

You must apply for it at the immigration office in the province where you wish to reside or the corresponding police station.

So those of us with Residencia, but with less than 5 years here will be obliged to apply for permanent residence under the general immigration regime?

It looks as if those of us with temporary residency documentation, including myself, will eventually (who knows when?) be asked to complete fresh TIE documentation (which may include a photocard?), taking account of the date when we first took up residence here.

But there are no details yet of when that will be, how it will be administered, etc. I'm just posting what Spanish and British government publicise and have no expert knowledge. Meanwhile I'm keeping my residency credit card size ID in a safe place!
