Double Taxation
Hi Can someone explain Double Taxation with the UK & Spain ( in layman's terms please)
Thanks
basically if you have to pay tax on your income in the UK by law you do not pay it again in Spain. I don't think that means you can choose where you pay the tax. if a resident of Spain you have to pay the tax due on all of your income but if you have a government or civil service pension that is taxable you pay that in the UK. However, if like my husband, you receive a low pension his is Army which is not taxable in the UK it is included in your income for tax calculations in Spain. Does that help!

I agree with the previous message regarding government occupational pensions, except if you are also receiving an oap (state pension) you have to pay tax on it in Spain. If you don't declare it you could be charged with up to 4 yrs(I think that is right) back tax, plus interest plus fines. Depending how long you have lived here. Then you don't have to pay tax on said pension in UK. But you will obviously have to let the HM Customs and Revenue know that you are now paying it in Spain. Hope this also helps.

Ask for an appointment with Tim Taplin at Indalo Partners in the Commercial Centre, Mojacar. He can give definitive advice on your personal situation. I happened to see Tim today to pay for my first Spanish Resident's tax return which he completed for me. I also have an Army pension plus State pension. Basically they were both declared but bottom line I pay nothing as I was not resident here until this year and both were taxed in UK. However in Aug he is completing the double taxation forms for me and I'll pay tax in Spain on my state pension in the future.

That's more or less what I said. The tax we paid this year was for year 2019 which in Spain runs from Jan to Dec unlike the UK tax which is from April to March.
