Hi. I have dual citizenship British and American and reside in the US. I am wanting to move to Spain but first will visit. Do I need a Visa as I carry a British and US passport? Also as a visitor, how long can I stay in the country and how many times can I come in and out? As residents of other countries would it be hard for us to get residence in Spain? Any advice/info greatly appreciated.  Thanks

As a British passport holder, you won’t need a visa.  Prior to Brexit, you can stay and work in the country for up to 90 days in any 180 day period.

After Brexit, you will still be able to stay in the country for 90 days but would need to apply for work visas if you wished to work - same as on US passport; similarly, post Brexit, if you wish to reside here, the rules will be the same as if you only had a US passport.  You will need to meet the criteria for a Tarjeta de Identidad Extranjero regarding health insurance and income to name but two.

If you get here before Jan 31st 2020, you will still be able to apply under the “old” regime on your British passport, then convert to the “new” without having to meet the new income requirements which are scarily high for this area of Spain.

Thats asI understand the situation as it stands today.  A lot depends on the outcome of today’s General Election in the UK and if Brexit occurs, how EU citizens in U.K. are treated

If you come after the Transition period ends, if I recall Chrisso50 correctly, it’s an initial income of about 25.000€ per year, going up to 56.000€ per year for renewal two years later.  Chrisso50 posted the figures in another thread - I’ll see if I can find it and link it here

So my plan is to continue working 8 week  contracts in the States, then coming over for about 4 week stayes every 8 weeks and just renting a place long term. So I'd be visiting 4 times a year for a month each time. Would I be allowed to do this with my British and US passport as a visitor or will I need to get Spanish residency? Which would be better? I intend on retiring out there eventually but like I said, i want to come out every 2 months for a month at a time. Thanks

To my mind, that will keep you well within the 90 days in any 180 limit - HOWEVER, after the end of the transition period, permanent residence will become as difficult to obtain as if you were on your American passport.  If you eventually intend retiring here, it will be well worth your while obtaining Residencia on your U.K. passport before the end of the transition period.

Application for residence under the Third country / TIE regimen incurs some very heavy financial requirements, as well as a requirement not to spend more than 6 months outside of Spain.  If you wish, I can find the thread that deals with requirements for applications after the end of the transition period ...

My advice, for what it’s worth, is to obtain your Residencia on your U.K. passport as soon as is possible
