EU long term Resident card/permit

Hi

I was looking at a house to buy in Mojacar. I explained to the agent that I have a UK passport, a house in France with a 10 yr residency permit (carte de sejour). The agent told me that buying in Spain would be easier if I had the EU residency permit. So off I went to my prefecture in France to apply for the EU residency permit, but they said they had never heard of it.

I have looked for hours online and although I can find information about the EU long term residency permit, I cannot find how to apply for it.

So does anyone have this permit and how do I apply for it ?

To my understanding there is no such thing as an EU residency permit - each country within the EU has separate and discrete legislation covering residency.  Obtaining residency in Spain is different to obtaining residency in France, is different to obtaining residency in Portugal, is different to obtaining residency in Germany .... you get the picture.

What the link you've posted states is that if you live uninterrupted in ANY EU country (having gained that countries residency) then after 5 years you automatically become a permanent resident of that country.

This residency does not flow through to other EU countries unfortunately and to become a resident of Spain you would have to make application for residency under the various pathways dictated by your passport.

As a resident of 1 eu country surely you can travel to another eu country and stay as long or often as you wish, allowing for factors such as living somewhere for more than 5 years etc. If you are a French resident and wish to buy in Spain then as an eu resident surely you can.

Nope, sadly not.  Being a permanent resident of Spain does not give you freedom of movement to other EU countries.  In fact, even as a permanent resident of Spain, once you leave Spain you are still restricted (on a UK Passport) to 90 days in every 180 in other Schengen countries.

It is ONLY EU citizens that continue to enjoy Freedom Of Movement (the ability to live and work in any EU / EC member nation), not EU residents.  That is why loss of F.O.M was such a big deal following Brexit.

You are absolutely right (treaty of schengen ) did you heard about it .

England or the uk is not a member of schengen any more .

Brexit you know.

As long as you travelled from France your passport would not be affected by the 90 day rule as you travelled through a border less crossing from France to Spain so there would be no record of you entering Spain . Not legal but very hard to get caught and you could argue that you have been in Spain less than 90 days in 180. That's if you are maintaining a french address

Hi, Dario, as is often the case is absolutely correct, I know, I had French residency, that's FRENCH, not EU. Now have Spanish residency, they were not interested one jot re my French residency. 

Jimh is also correct, however, the onus is on YOU to prove how long you have been in place A or place B, note the YOU.

The uk have never been a member of the Schengen area as indeed is Ireland and they still are not

Still i am glad that i can live where  i want because soy un ciudadana de europeo 

183 days in spain and the rest of the year in my home country and after a few years i’ll

Become a resident paying my taxes in spain .happy days .
