Hi all

New to area..hoping to buy a property near santa maria and it has no AFO...seller is gona pay for it but my lawyer has told me it could take a year??

Anyone else had this??..

also my lawyer has said would i consider paying 10% and then paying a rent each month (which would come off purchase price) and then we could move in to house and wait for AFO the sign deeds...

All seems a bit odd

Any thoughts much appreciated

Avoid at all costs.

Buy a fully legal house and avoid the worry.

A 12 month wait in Spain can turn into 12 year wait.

We were offered to rent the house and pay 10% of purchase price...while we wait ...seems dodgy to me

We purchased a house nr Urcal 5 yrs ago without an AFO 

We knocked 7k off the price for this issue 

Once we completed we set about getting an AFO this is mainly driven by a Architect completely redrawing the house plans in great detail for submission to the planners at town hall 

Total cost Architects 2k , AFO tax 5k ( but varied on house size) 

Plus as a planning trade off we had to agree to install a 3 chamber septic tank and do away with Pozzo

So all up 9k  took 7 to 9 months total , we also rolled into the negotiations permission to build a pool

One of our neighbours is in the middle of a "rent until AFO sorted out" contract like that you were offered. Not that unheard of round here.

Also note that if the property is older (pre 1975 I think, but a local architect could confirm the dates that matter, and I can recommend one if you need one) the cost is a lot lower and it's not strictly an "AFO", but a regularisation of a property that existed before the current planning regime. It seems that it hardly matters what the property was either (as there was no designated uses back then), just that it clearly appears on records.
