I have Residency it says RESI Y Trabajo Temporal and was issued under 18.4 withdrawal agreement. I am in my third year here and have paid my taxes in Spain. It says my Residence card Is due fir renewal in 2025 ,I have heard that your only allowed to spend 10 months out of Spain in the five year period to  be able to renew your Residence ? Please could someone advise on how long your allowed to stay out of Spain as I like to go back to the uk for summer months?

Many thanks For Any advice Please.

If you are covered by the WA then you can be out of Spain for 6 months per year....when you're permanent...as in after 2025 renewal....you can leave for 5 years

I stand to be corrected but I am not sure that is totally true.

My understanding is that you can be out of the country for 180 days in any one year but the total of time out of the country in a 5 year period must not exceed 12 months ( I understand that used to be 10 months ).

Just editing this. If your original statement was true why would you have considered Residency in the first place if you wanted to spend summer elsewhere? Assuming you are  a UK national you can already spend 180 days per year in Spain albeit  90 days in any 180. It sort of defeats the objective of 'residency'.

Cake and eat it too comes to mind.

The 10 months in the first 5 years is only for people applying that are not covered by the Withdrawal Agreement , which if you're covered by it you can spend 6 months per year out of Spain

I am covered by the WA and have had residency for 4 years. This is news to me. That was not my understanding when I gained residency. I have seen no reference to your statement and logic says its not true. The OP had obviously heard the same information as me.

I have always believed that it was 10 months in total in the first 5 years ( although there are conditions for certain situations where this may not apply ie; working out of the country and others ).

In reality I don't think its much of an issue - until one day you get stopped at immigration and get questioned.

I'm sure more informed people will enlighten us ( Dario maybe? ) and if I'm wrong I apologise in advance.

I'm not sure what you mean by 2025 renewal - I presume you mean for all those that got residency just before 31st Dec 2020. For others it was earlier than that, myself included. And I'm absolutely certain that even if you did get a renewal in 2025 you would not be able to leave Spain after that for 5 years and still be entitled to residency.

I am not convinced. There many websites posturing to know the truth and nearly all are wrong in some manner.  Provide a reference to Spanish Government directive on the subject and I will believe you.
