Winters in Spain after brexit.

Until the end of 2020 there will no diffence but after that your probably be subject to the 90 days in 180, so you would be  restricted to 3 months stay maximum over the winter period.

My understanding of the situation is also the same as Tony 3121.

However, it would be best to see how things pan out between the E.U and the UK in the next 12 months

You can spend 90 days in one year return to the UK and come back in the New year for a further 90 days as it is per calenders year.

The 180 days is Rolling, it does not reset per calender year.

Thank you all for replies. What a stupid rule ! The only way around it is to get Spanish residency before brexit date I suppose.

Would this be possible/easy? I’m on long term sickness benefits, will be for life probably, unless a miracle! I’m only really interested in spending the winter there to avoid uk winter, but 3-5 months would be ideal. What a pain!

Definitely possible .... you’d need to prove income under the old Residencia rules before December 2020.  Only snag may be the length of time you spend in Spain.  I saw a post from Chrisso50 regarding people applying to come here after the Transition period ends, will not have permits renewed if they don’t spend 6 months of the year here; now I must state I have no idea how things are going to change post Brexit - we don’t actually even know yet whether we will have to swap current Residencia cards for a TIE or whether Spain will just continue to recognise our rights enshrined within the withdrawal agreement and not require change.  It’s 50/50 - on the one hand maintaining the status quo is less labour intensive and would certainly not cost Spain as much ... on the other hand, Spain LOVES bureaucracy with an intensity that is frightening.

But to get back to your question - yes, I believe it may be possible (this is only my opinion) but I’d suggest talking to a Gestor here - someone who has plenty of experience dealing with Extranjeria and who knows the current mindset

Ok so why in this week's Euro weekly news does David Searl (You and the law in Spain) state that Spanish law says you can stay in Spain as a tourist for 90 days in a calendar year?  Is he wrong?

Yes he is wrong as you can stay in Spain for 180 days in 12 months. But there must be 90 days between them and it is a rolling year.
