Just a message to any people who are non residents that have been informed that you don’t have to complete a new Padron every two years. We bought a property and lived here from 2004 where we completed every form that was needed, in 2009 we decided that we would just keep our villa just as holiday home and went back to the UK and visit every 3-4 times a year, up until last year we have completed a Padron every 2 years, then when I was reading the forum earlier this year I found that it was stated that if you were a non- resident you should not complete a Padron. So we didn’t bother completing one when we came in May, in June I had a voicemail to my phone whilst in the UK telling me to go to the town hall to do the said Padron, I sent an email back stating we would not be back here until September, when we came earlier this month we had to go to the Solicitor to do our non- residents tax form, I asked the solicitor if we should complete a Padron she said yes, as we have been rather busy since we arrived we were going over to the Town Hall on Tuesday to collect our water bill ( which we only found out last week they have to be collected only on a Tuesday or Thursday) when this evening 2 Official Officers came to our Villa at 8.30 telling us that we haven’t completed this years Padron and must go to the town hall ASAP to complete one. So this is just to let people know to check if they are non residents if they have completed one.
There are literally thousands of posts on various forums about this. Non residents should not be on the padron. The Spanish tax authorities are fining people for not completing tax returns as resident, as they are on the padron, so deemed as resident. There is a lawyer being sued by numerous British clients for giving bad advice. Obviously can’t say her name, but think of a German car, and flower. Hope it’s not your lawyer.
if you are non resident then you do not have to register on the padron. In Arboleas the town hall had a lot of the ex pats registered to boost their population figure which helps with their share of funds from the Junta but it is not legal. As stated if registered on the padron you are considered as a full time resident by the tax office which would be very awkward for you if they decide you must pay tax in Spain. Tell the townhall you are non resident.

You need to complete a form to be removed from the padron. You must not be on the padron if non resident.
Hi Thank you all for your comments concerning my post about the Padron, My husband and myself will be going over to the town hall tomorrow to see someone over there. Whilst I am questioning the Padron issue We have also been asked by a friend why do we pay IBI if we are not residents here? We have paid this since it was introduced, and when were speaking to a friend of ours said he had his bill and it was €307 we paid €371 this was why he queried why we pay it. If anyone has any input about this I would be grateful.

IBI has nothing to do with residency. It’s like the council tax in UK, you would pay on any property you own

Thank You we did think this but as with the issue of the Padron we are getting different comments and answers on all sorts, we don’t know if we’re coming or going!!! So We will ask several different queries at the Town Hall, but once again thank you for your reply.

With regards Padrón, C.A.B Spain has posted advice from a solicitor on this: Non-Residents MUST NOT be on the Padrón. This is because having a Padrón makes you quasi-resident in the eyes of Spanish authorities, and states that this is your place of normal residency; it can effectively make you tax-resident and liable for enormous amounts of back tax
A further complication to being on the Padrón as a non resident is the issue of driving. If you drive a Spanish plated car with a UK licence and have been on the Padrón for more than 6 months, you may be fined for driving on an invalid licence, as Residents have only 6 months to get a Spanish licence.
If again you are on the Padrón and bring your own car across, not only are you risking a large fine, but the car may be impounded as well (this is exactly what happened to someone as related by C.A.B Spain)
The Ayuntamiento will probably urge you to stay on the Padrón, because the more people that are on, the more money they get and they really couldn’t care if it causes problems for you.
You will be naturally cautious of accepting information / advice from a forum, so I would urge you to look up C.A.B Spain and see the advice there from a solicitor with regards Non-residents being on the Padrón.

Hi Dario Martin Thank you for your information we read this and we’re again pleased with the reply. But, we took your advice and went on the C.A.B site where I entered my question “ as a non resident do I have to register on the Padron” it does indeed say non residents must not go on the Padron, to which my husband and myself were delighted to at last have really sound advice where we decided that we will go to the Town Hall and tell them. After reading the answer to our question I carried on reading the rest of the advice given on the subject, then after reading about 5-6 queries down a lady had posed the question “ my husband and I are non EU residents do we need to go on the Padron” the answer states yes you do. So unfortunately we are again no nearer to the right answer!!!! But thank you anyway for telling us about the C.A.B where we can now take this information with us tomorrow in black and white and see what they come up with.
You’ve already been given the correct answer. Non residents should not be on the padron.
